HomeMy WebLinkAbout156 - 12/18/1979 - PROVIDING FOR THE COLLECTION OF A STORM DRAINAGE PLANT INVESTMENT FEE (10/16/1979 ADOPTED 1ST READIN ORDINANCE NO 156 , 1979 OF THE COUNCIL OF THE CITY OF FORT COLLINS PROVIDING FOR THE COLLECTION OF A STOPM DRAINACE PLANT INVEST1ti,ENT FEE WHEREAS, new development within the City should provide for the construction of drainage facilities necessary for the drainage and control of flood and surface waters within the drainage basins within which that new development is located and should also provide the facilities required to convey such waters from said drainage basins to major drainageways, and WHEREAS, in the considered opinion of the Council of the City of Fort Collins, the most practical means of insuring that said development provides required storm drainage facilities is to attach a storm drainage plant investment fee to the issuance of buildinq permits N Mt, THEREFORE, BE IT GRDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS AS FOLLOWS Section 1 That there is hereby imposed a Storm Drainage Plant Investment Fee for the purpose of providing for the acquisition, upgrading, design, and construction of storm drainage facilities r,ithin newly develOU- ing areas of the City Section 2 Pending the completion of the storm drainage basin studies contemplated by Chapter 93 of the Code of the City of Fort Collins, the Storm Drainage Plant Investment Fee S -all be determined as follows A fee calculated at the rate of 1 G545 per square foot net lot area Tor all uses At such time as the specific storm drainage basin studies referred to above have been completed, the fees set forth above shall be adjusted in accord- ance with said studies to reflect the true cost for providing the necessary storm drainage improvements To the extent, if any, wrich the fees set fortn above exceed those fees determined by the storm Grainage basin studies, then, in that event, the difference shall be refunded to the property owner of record at the time the storm drainage basin studies are completed Fortner, when a basin plan is completed and approved and when in some cases on site subdivision inorovt�,rents have been made, credit may be granted or a basin basis predicated on the previous improvement which reduces overall basin iriprovenent costs Section 3 The Storm Drainage Plant Investment Fee shall be in addition to all other storm drainage utility fees 12/i/yq 7 bete Inc(PC k"1�17
