HomeMy WebLinkAbout158 - 12/04/1979 - VACATING A PORTION OF THE MACK STREET RIGHT-OF-WAY IN THE WASHINGTON PLACE ADDITION ORDINANCE NO 158 , 1979 BEING AN ORDINANCE VACATING A PORTION OF THE MACK STREET RIGHT-OF-WAY IN THE WASHINGTON PLACE ADDITION WHEREAS, the original plat of the Washington Place Addition, which was filed May 12, 1903, with the Larimer County Clerk and Recorder, contained a dedication for Mack Street one hundred (100) feet in width, and WHEREAS, the Council of the City of Fort Collins vacated the west twenty (20) feet of the Mack Street right-of-way in October, 1973, and WHEREAS, the property owners adjacent to the existing Mack Street right-of-way have petitioned the Council of the City of Fort Collins to vacate a portion of said right-of-way, and WHEREAS, the portion wnich the petitioners requested be vacated is not used nor intended to be used for municipal purposes and in the opinion of the Council of the City of Fort Collins should be vacated NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the following described portion of the existing Mack Street right-of-way, to-wit The west five (5) feet of such street adjoining Lots 1 and 24 in Block 2 and Lot 1 in Block 3 of said Washing- ton Place, be, and the same hereby is, vacated, abolished and abated, said right-of- way not being needed for any municipal purpose Nothing herein shall affect Mack Street as dedicated and shown in the amended plat of Washington Place filed May 21 , 1906, in the Office of the Clerk and Recorder of Larimer County Introduced, considered favorably on first reading, and ordered pub- lished this 6th day of November , A D 1979, and to be p-e- sented for final passage on the 4th aay of December A D 1979 t T City C �erk I A - Passed and adopted on final reading thin 4th day of December , A D 1979 Mayor" ATTE 7 ;"r ci cle -2-
