CITY OF FORT COLLINS RELATING TO THE CREATION AND ORGANIZATION OF STMI SEWER IMPROVEMENT DISTRICT NO 17 , AND PROVIDING FOR THE CONSTRUCTION OF IMPROVEMENTS THEREIN WHEREAS h\tofore the necessary proceedings were instituted to create a special improvement district for the purpose of installing the improvements described on Exhibit "A" attached hereto (hereinafter some- times referred to as ",tne improvements") for the benefit of the property described on Exhibit "A , and WHEPEAS, the City Council has received the necessary reports, and given the required notice of�intent to form such district, and pursuant to notice duly given, a hearing on the formation of said district was held by the City Council on December 4,\1979, and WdEFEAS, as a result of th\protests and other information received at said hearing, the City Council Chas directea the City Enqireer to ma4e certain changes in the plans for saod district, which cnanges nave been made and approved by the City Council ,\and WHEPEAS, in the considered opinion of the Council of the City of Fort Collins, it is in the best interests of the City of Fort Collins to form said special improvement district NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS Section 1 That there is hereby created and organized an improvement district under and by virtue of the provisions of Chapter 16 of the Code of the City of Fort Collins, to be .norm as Storm Sewer Improvement District No 17 (hereinafter sometiiies referred to as "the district") comprised of the property described on Exhibit "A" attached hereto Section 2 That the ir^provei,ents to be constructed shall consist of the improvements described on Exhibit "A" attached hereto, all as more fully set forth in the map, plans and specifications eeretofore submittea by the City Engineer and accepted by the City Councir byeresolution Section 3 That the total cost of such improvements shall not exceed by more than five percent (5%) the City Engineer ' s estimate heretofore accepted of Four Hundred Fifty-Two Thousand Nine Hundreo Seventy\Doildrs ($d52,970 00) , exclusive of the expense of collection, legal , advertising, engineering, financing, interest during construction and other incidentals, and that said total costs, togetner with such expense of collection, legal , advertrsinn, engineering, financing, interest during construction and otn r —Denied incidentals (20% of the cost of such improvements) shall be assessed against the property in said district in the manner set forth on Exhibit "A" attached hereto in accordance with the provisions of Chapter 16 of the Code of the City of Fort Collins Section 4 That the City Council has, pursuant to notice duly mailed and published, all as provided in Chapter 16 of the Code of the City of Fort Collins, considered all complaints and objections made and filed in wr)t)nq by the owners of any real estate to be assessed or any persons interested, and the City Council further finds that all requirements of the ordinances of the City of Fort Collins respecting the organization of the district have been observed and complied with in all respects, and it is hereby ordered that the improvements in the district as provided for in tine map, olans and specifications heretofore adopted by the City Council be and they hereby are ordered to be constructed Section 5 Upon the taking effect of this ordinance, the Mayor is hereby authorized and empowered to advertise for bids for the construction of the improvements in accordance with the map, plans and specifications heretofore adopted, which advertisement shall be twice published in an official newspaper published in the City, unless otherwise waived by all participants of the district Said publications are to be at least a week apart, and the plate for opening of bids shall not be less than ten (10) days afte- first publication, and bids received under said advertisement shall be submitted to the Courcil for approval or rejection Advertise- ments for bids shall comply with the requirements and be in accordance with the provisions of Chapter 16 of the Code of the City of Fort Collins Section 6 When the improvements herein authorized have beer) com- pleted and the same approved and accepted by the City of Fort Collins, the costs as set forth above shall be assessed upon the real property in said improvement district, all as here)nbefore set forth Section 7 This ordinance shall be )rrepealable until the indebted- ness herein provided for, whenever the same shall be improvements to be installed in the district and to be assessed for the costs incurred in making said improvements A parcel of land being a portion of the East one-half of Section 35, Township 7 North, Range 69 West of the Sixth Principal Meridian, Larimer County, Colorado, and further described as following Beginning at a point approximately 150 feet West and 30 feet North of the Southeast corner of said Section 35, said point being the point of intersection of the Northerly right-of-,vay line of Harmony Road and the Northwesterly right-of-way lire of the U S Highway 287 - Harmony Road intersection, Thence running Westerly along said Nortnerly right-of- %%ay line of Harmony Road approximately 856 5 feet to the point of intersection of the Northerly right-of-way line of Harmony Poad and the Easterly right-of-way line of the Colorado and Southern Railroad, Thence, leaving said Northerly right-of-way line of Harmony Road, and running Northerly along said Easterly right-of-way line of the Colorado and Southern Railroad approximately 4,724 feet to the point of intersection of the Easterly right-of-way line of the Colorado and Southern Railroad and the center of an irrigation ditch, Thence, leaving said Easterly right-of-way line of the Colorado and Southern Railroad, and running generally Southeasterly along the center of said irrigation ditch approximately 1,060 feet to the point of intersection of the center of the irrigation ditch and the Westerly right-of-way line of U S Highway 287, �l Thence, leaving said center of the irrigation ditch, and running Southerly along said Westerly right-of-way line of U S Highway 287 approximately 4,258 feet to the point of intersection of the Westerly right-of-Nay line of U S Highway 287 and the Northwesterly right- of-way line of the U S Highway 287 - Harmony Road intersection, r Thence, leaving said Westerly right-of- vay line of U S Highway 287, and running generally Southwesterly along said Northwesterly right-of-way line of the U S Highway 287 - Harmony Road intersection approximately 141 feet to the Point of Beginning, Excepting that certain parcel of land described in deed, recorded in Book 1577, Page 712, records of said County, said parcel belonging to The Wickes Corpora- tion, Containinq 92 05 acres more or less, (B) Improvements to be installed in the district consist of The installation of storm sewer lines to provide storm drainage for properties in the district and to carry off storm waters from properties in the district (C) The cost of makinq the improvements in the district
