COLLINS BEING AN ORDINANCE AMENDING ARTICLE III OF CHAPTER 112 OF THE CODE OF THE CITY OF FORT COLLINS RELATING TO THE CITY ELECTRIC UTILITY AND RATES FOR SERVICES FRO"1 SUCH UTILITY AND PROVIDING FOR THE PURCHASE OF ELECTRIC ENERGY FROM CO-GENERATION AND SMALL POWER PRODUCTION FACILITIES PROVIDED THAT THE QUPLIFYING FACILITY COMPLIES WITH STANDARDS SET FORTH HEREIN BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS AS FOLLOWS Section 1 That Section 112-118 of the Code of the City of Fort Collins be, and it hereby is, amended to read as follows "§112-118 Schedules The following schedule of rates is hereby adopted and approved, which shall be the lawful rates for the City of Fort Collins to charge and collect fo► all electrical service of every kind, both within and without ie corporate limits of the City of Fort Collins, for customers connected to the distributing system of the said City of Fort Collins, being the schedule of rates referred to in §112-117 of this Code A Schedule R Residential Service (1) Availability This schedule shall be available within the corpo- rate limits of Fort Collins and the suburban fringe (2) Applicability, Single-Family Basis This schedule applies to residential customers for all domestic uses, except space heating, in single- family private dwellings , individually metered apartments, and home occupations defined in Section 118-81(c) of the City Code This schedule may be applied to existing dwellings having electric heat as a primary or auxiliary energy source for space heating prior to January 1, 1980 This schedule does not apply to auxiliary or standby service or service capacity in excess of 200 amperes (3) Monthly Rate Fixed charge, per account $ 1 78 Demand charge, per kilowatt-hours First 1,000 kilowatt-hours $ 0366 All additional kilowatt-hours $ 0227 Energy charge, per kilowatt-hour $ 0105 In lieu of taxes and franchise Percent of total charges billed 3 75% Per kilowatt-hour $ 001038 (4) Excess Capacity Charge A monthly capacity charge of $2 00 per kilowatt may be added to the above charges for service to intermittent loads in accordance with the provi- sions of the Electric Service Rules and Regula- tions (5) Service Charge There shall be a service charge of $11 00 for the processing of a request for elecrical service under this schedule, except where the request is made for after hours service, in which case the service charge shall be $70 00 The service charge is further applicable for a special meter reading and/or fractional period billing (6) Underground Annexation Charge There shall be an additional charge of $3 00 per month per customer for all annexed customers previously served by Public Service Company of Colorado and subject to that company's underground residential rates (7) Interruptible Water Heater Service Upon application by a minimum of 500 customers, utility-controlled water heater service will be available, on an optional basis, to primary use electric water heaters with single element capaci- ties of 4 5 or more kilowatts Control equipment will be owned, installed and maintained by the Utility This service is subject to the availabil- ity of suitable load control equipment Each customer having such load control equipment shall receive a monthly credit of $1 50 -2- (8) Applicability, Multi -Family Basis (Schedule RM) Master metering is not available for new or re- modeled residential buildings with more than one dwelling unit Master-metered residential build- ings served under this schedule prior to January 1, 1980 will be charged according to the foregoing rate schedule with each step of the demand charge multiplied by the number of dwelling units served (9) Payment of Charges The foregoing rates are net Payment becomes delinquent 25 days after the billing date (10) Contract Period All contracts under this schedule shall be for a minimum period of 30 days, and thereafter until terminated upon ten day's written notice to the City (11) Rules and Regulations Service supplied under this schedule is subject to the terms and conditions set forth in the Fort Collins Light and Power Utility Rules and Regula- tions as approved by the City Council Copies may be obtained from the City of Fort Collins Utility Billing Office, 300 LaPorte Avenue, Fort Collins, Colorado B Schedule RD Residential Demand Service (1) Availability This schedule shall be available within the corpo- rate limits of Fort Collins and the suburban fringe (2) Applicability This schedule applies to new residential dwellings having electric heat as a primary or auxiliary energy source for space heating of s2ngle-family private dwellings, individually metered apartments, and home occupations defined in Section 118-81(c) of the City Code This schedule may be applied to -3- 1 any individually-metered residential dwelling This schedule does not apply to master-metered multiple dwelling residential buildings or resi- dences with a service capacity in excess of 200 amperes (3) Monthly Rate Fixed charge, per account $ 2 81 Demand charge, per kilowatt $ 2 94 Energy charge, per kilowatt-hour $ 0105 In lieu of taxes and franchise Percent of charges billed 3 75% Per kilowatt-hour $ 001038 (4) Excess Capacity Charge A monthly capacity charge of $2 00 per kilowatt may be added to the above charges for service to standby or installed and maintained by the Utility This service is subject to the availabil- ity of suitable load control equipment Each customer having such load control equipment shall receive a monthly credit of $1 50 (8) Parallel Generation The customer may operate cogeneration or small power production facilities in parallel with the Utility's system under this schedule provided that the Capacity Rating of the Facility shall not exceed ten kilowatts Energy generated will be credited to the customer on a net-energy billing basis The kilowatt-hour energy credit shall not exceed the customer's kilowatt-hour consumption during any monthly billing period (9) Payment of Charges The foregoing rates are net Payment becomes delinquent 25 days after the billing date (10) Billing Demand The billing demand shall be determined by suitable meter measurement of the highest 15 minutes inte- grated demand occurring during the billing period, and shall not be less than 50% of the highest kilowatt demand occurring in any of the preceding 11 months (11) Contract Period All contracts under this schedule shall be for a minimum period of 30 days, and thereafter until terminated upon ten day's written notice to the City (12) Rules and Regulations Service supplied under this schedule is subject to the terms and conditions set forth in the Fort Collins Light and Power Utility Rules and Independence Day, Labor Day, Thanksgiving and Christmas (12) Contract Period All contracts under this schedule shall be for a minimum period of 90 days, and thereafter until terminated upon ten day's written notice to the City (13) Rules and Regulations Service supplied under this schedule is subject to the terms and conditions set forth to the Fort Collins Light and Power Utility Rules and Regula- tions as approved by the City Council Copies may be obtained from the City of Fort Collins Utility Billing Office, 300 LaPorte Avenue, Fort Collins, Colorado D Schedule GS General Service (1) Availability This schedule shall be available within the corpo- rate limits of Fort Collins and the suburban fringe (2) Applicability This schedule applies to lighting service or combined lighting and power service to commercial and industrial customers including hotels, motels, fraternities, sororities, clubs, lodges, rooming houses, rest homes, tourist camps, churches, hospitals, and similar uses, and residential service over 200 ampere capacity, and optionally, for apartments and multiple dwellings in existence prior to January 1 , 1980 where more than one dwelling or single living quarter is served through one meter Standby service will be demand metered This schedule applies to service through one meter at single-phase or, where available, three-phase secondary voltage Single-phase motors from one to five horsepower may be connected with the approval of the Utility -8- (3) Monthly Rate Fixed charge, per account Single-phase, 200 amp service $ 2 55 Single-phase, for service to standby or intermittent loads in accordance with the provisions of the Electric Service Rules and Regulations (5) Service Charge There shall be a service charge of $11 00 for the processing of a request for electrical service under this schedule except where the request is made for after hours service, in which case the service charge shall be $70 00 The service charge is further applicable for a special meter reading and/or fractional period billing (6) Demand Metering A demand meter may be installed by the Light and Power Utility whenever an account exceeds 1,500 Kwh during any of the preceding 12 months (7) Billing Demand The billing demand shall be determined by suitable -9- meter measurement of the highest 15-minute inte- grated demand occurring during the billing period and shall not be less than 65% of the highest billing demand occurring in any of the preceding 11 months (8) Power Factor Adjustment Power factor shall be determined by periodic testing using graphic watt and VAR instruments Such test results shall be the basis of billing adjustment until satisfactory correction has been made Periodic testing shall be conducted on an approximate 6-month schedule or as otherwise determined by the Utility If the power factor falls below 90% lagging, power factor adjustment may be made by increasing the billing demand by 1% for each 1% or major fraction thereof by which the power factor is less than 90% lagging This adjustment shall be based on the power factor at the time of maximum demand as recorded during the periodic test (9) Payment of Charges The foregoing rates are net Payment becomes delinquent 25 days after the billing date (10) Contract Period All contracts under this schedule shall be for a minimum period of 30 days, and thereafter until terminated upon ten day's written notice to the City (11) Rules and Regulations Service supplied under this schedule is subject to the terms and conditions set forth in the Fort maximum demand as recorded during the periodic test -12- (9) Interruptible Service Interruptible service may be provided under this schedule on an as available basis Unless other- wise provided for by separate contract for inter- ruptible service, the Billing Demand charges will be at the off-peak rate and such service is subject to unlimited interruption by the Utility without notice The hours of interruption will generally not exceed one (1 ) of 8 hours duration in any day and generally will not, in the aggregate, amount to more than 400 hours in any period of 6 consecutive months Service under this provision requires monitoring and direct control of all loads by the Light and Power Utility Load Dispatcher Approved independent metering, suitable control equipment, and communication services shall be provided by the customer The 65% minimum provi- sion of the past 11-month high billing demand will not apply to this service In addition to the charges computed in accordance with the uninter- ruptible provisions of this rate, the interruptible customer shall pay a penalty of three (3) times the on-peak Billing Demand for each month in which said customer either (i ) falls to shut down his interruptible load for any reason, including cus- tomer equipment failures or communications system failures, or ( ii ) the customer resumes operation of said interruptible load prior to notice by the Light and Power Utility that said operation may be resumed Interruptible service contracts between the customer and the Light and Pourer Utility and/or the Utility' s power supplier rill be re- quired where modification of the provisions in- cluded herein are necessary to meet customer and utility constraints By making application for interruptible service, the customer waives all liability of the Light and Power Utility and the Utility's power supplier for consequential damages resulting from interruptions in accordance with this schedule (10) Payment of Charges The foregoing rates are net Payment becomes delinquent 25 days after the billing date (11) Contract Period All contracts under this schedule shall be for a minimum period of 90 days, and thereafter until -13- terminated upon ten day's written notice to the City (12) Rules and Regulations Service supplied under this schedule is subject to the terms and conditions set forth in the Fort Collins Light and Power Utility Rules and Regula- tions as approved by the City Council Copies may be obtained from the City of Fort Collins Utility Billing Office, 300 LaPorte Avenue, Fort Collins, Colorado F Schedule GS50 General Service 50 (1) Availability This service shall be available within the corpo- rate limits of Fort Collins and the suburban fringe (2) Applicability This schedule applies to customers served at the established secondary voltage of the City's distri- bution system and having three-phase service This schedule may also apply to customers having a single-phase service with approval of the Light and Power Utility (3) Monthly Rate Fixed charge, per account $15 52 Demand charge, per kilowatt but not less than 50 kilowatts $ 8 56 Energy charge, per kilowatt-hour $ 0105 In lieu of taxes and franchise Percent of charges billed 3 75% Per kilowatt-hour $ 001038 (4) Excess Capacity Charge A monthly capacity charge of $4 28 per kilowatt may be added to the above charges for service to standby or intermittent loads in accordance with the provisions of the Electric Service Rules and Regulations (5) Service Charge There shall be a service charge of $41 50 for the processing of a request for electrical service -14- under this schedule except where the request is made for after hours service, in which case the service charge shall be $70 00 The service charge is further applicable for a special meter reading and/or fractional period billing (6) Billing Demand The billing demand shall be determined by suitable meter measurement of the highest 15-minute inte- grated demand occurring during the billing period and shall not be less than 70% of the highest kilowatt demand occurring in any of the preceding 11 months (7) Power Factor Adjustment Power factor shall be determined by periodic testing using graphic watt and VAR instruments Such test results shall be the basis of billing adjustment until satisfactory correction has been made Periodic testing shall be conducted on an approximate 6-month schedule or as otherwise determined by the Utility If the power factor falls below 90% lagging, power factor adjustment may be made by increasing the billing demand by 1% for each 1% or major fraction thereof by which the power factor is less than 90% lagging This adjustment shall be based on the power factor at the time of maximum demand as recorded during the periodic test (8) Primary Service Where service is metered under this schedule at primary voltage, a discount shall be made each month of 1 1/2% of the bill for service Where service is taken at the City's established primary voltage and the City does not own the transformers and substations converting to secondary voltage, an additional credit of 2% of the monthly bill shall be allowed A charge additional to the schedule shall be made each month of 2% of the bill for service at 2,400 volts or 4,160 volts (9) Payment of Charges The foregoing rates are net Payment becomes delinquent 25 days after the billing date -15- (10) Contract Period All contracts under this schedule shall be for a minimum period of 90 days, and thereafter until terminated upon ten day's written notice to the City (11) Rules and Regulations Service supplied under this schedule is subject to the terms and conditions set forth in the Fort Collins Light and Power Utility Rules and Regula- tions as approved by the City Council Copies may be obtained from the City of Fort Collins Utility Billing Office, 300 LaPorte Avenue, Fort Collins, Colorado G Schedule GS50T General Service 50 Time-of-Demand (1) Availability This service shall be available within the corpo- rate limits of Fort Collins and the suburban fringe The Utility reserves the right to decline applications for this service based on the avail- ability of excess off-peak capacity (2) Applicability This schedule applies to customers served at the established secondary voltage of the City's distri- bution system and having three-phase service This schedule may also apply to customers having a single-phase service with approval of the Light and Power Utility Service under this schedule is subject to availability of suitable metering and control equipment (3) Monthly Rate Fixed charge, per account $20 88 Demand charge, per kilowatt On-peak kilowatts, but not less than 50 kilowatts $ 8 56 Off-peak kilowatts, in excess of on-peak Charge There shall be a service charge of $41 50 for the processing of a request for electrical service under this schedule except where the request is made for after hours service, in which case the service charge shall be $70 00 The service charge is further applicable for a special meter reading and/or fractional period billing (6) Billing Demand The billing demand shall be determined by suitable meter measurement of the highest 15-minute inte- grated demand occurring during the billing period The on-peak demand shall not be less than 70% of the highest on-peak kilowatt demand occurring in any of the preceding 11 months (7) Demand Periods The on-peak demand is the period from 7 00 a m to 11 00 p m weekdays except holidays The off-peak period is anytime other than the above described on-peak period Holidays shall be defined as the following days New Year' s Day, Memorial Day, Independence Day, Labor Day, Thanksgiving and Christmas (8) Power Factor Adjustment Power factor recorded during the periodic test (9) Interruptible Service Interruptible service may be provided under this schedule on an as available basis Unless other- wise provided for by separate contract for inter- ruptible service, the Billing Demand charges will be at the off-peak rate and such service is subject to unlimited interruption by the Utility without notice The hours of interruption will generally not exceed one (1 ) of 8 hours duration in any day and generally will not, in the aggregate, amount to more than 400 hours in any period of 6 consecutive months Service under this provision requires monitoring and direct control of all loads by the Light and Power Utility Load Dispatchet Approved independent metering, suitable control equipment, and communication services shall be provided by the customer The 70% minimum provi- sion of the past 11-month high billing demand will not apply to this service In addition to the charges computed in accordance with the uninterrup- tible provisions of this rate, the interruptible customer shall pay a penalty of three (3) times the on-peak Billing Demand for each month in which said customer either (1 ) falls to shut down his interruptible load for any reason, including cus- tomer equipment failures or communications system failures, or ( 11 ) the customer resumes operation of said interruptible load prior to notice by the Light and Power Utility that said operation may be resumed Interruptible service contracts between the customer and the Light and Power Utility and/or the Utility' s power supplier will be re- quired where modification of the provisions in- cluded herein are necessary to meet customer and utility constraints By making application for interruptible service, the customer waives all liability of the Light and Power Utility and the Utility's power supplier for consequential damages resulting from interruptions in accordance with this schedule (10) Primary Service Where service is metered under this schedule at -18- primary voltage, a discount shall be made each month of 1 1/2% of the bill for service Where service is taken at the City's established primary voltage and the City does not own the transformers and substations converting to secondary voltage, an additional credit of 2% of the monthly bill shall be allowed A charge additional to the schedule shall be made each month of 2% of the bill for service at 2,400 volts or 4,160 volts (11) Payment of Charges The foregoing rates are net Payment becomes delinquent 25 days after the billing date (12) Contract Period All contracts under this schedule shall be for a minimum period of 12 months,and thereafter until terminated upon ten day's written notice to the City (13) Rules and Regulations Service supplied under this schedule is subject to the terms and conditions set forth in the Fort Collins Light and Power Utility Rules and Regula- tions as approved by the City Council Copies may be obtained from the City of Fort Collins and the suburban fringe (2) Applicability This schedule applies to customers served at the primary voltage of the City' s electric system ( 13,200/7,620 volts nominal ) for three-phase industrial power and combined lighting and power (3) Monthly Rate Fixed charge, per account $41 09 -19- Additional charge for magne- tic tape, single metering point $96 35 Additional charge for each additional metering point $22 03 Demand charge, per kilowatt but not less than 500 kilowatts $ 8 33 Energy charge, per kilowatt-hour $ 0105 In lieu of taxes and franchise Percent of charges billed 3 75% Per kilowatt-hour $ 001038 (4) Excess Capacity Charge A monthly capacity charge of $4 17 per kilowatt may be added to the above charges for service to standby or intermittent loads in accordance with the provisions of the Electric Service Rules and Regulations (5) Service Charge There shall be a service charge of $41 50 for the processing of a request for electrical service under this schedule except where the request is made for after hours service, in which case the service charge shall be $70 00 The service charge is further applicable for a special meter reading and/or fractional period billing (6) Billing Demand The billing demand shall be determined by suitable meter measurement of the highest 15-minute inte- grated demand occurring during the billing period and shall not be less than 75% of the highest kilowatt demand occurring in any of the preceding 11 months Magnetic tape metering equipment may be as specified by the Utility (7) Power Factor Adjustment Power factor shall be determined by periodic testing using graphic watt and VAR instruments Such test results shall be the basis of billing adjustment until satisfactory correction has been made Periodic testing shall be conducted on an approximate 6-month schedule or as otherwise determined by the Utility If the power factor falls below 90% lagging, power factor adjustment may be made by increasing the billing demand by 1% -20- for each 1% or major fraction thereof by which the power factor is less than 90% lagging This adjustment shall be based on the power factor at the time of maximum demand as recorded during the periodic test (8) Secondary Service Where service is rendered under this schedule at secondary voltage and the City owns and furnishes the transformer and substation converting to the lower voltage desired by the customer, an addition- al charge shall be made each month of 2% of the bill for sevice If, for any reason, metering is accomplished at secondary voltage, an additional 1 112% shall be added to the monthly bill Instru- ment-rated metering transformers shall be at the expense of the owner The Utility may require that transformers greater than 1,000 Kva be owned by the customer and that such load be primary metered A charge, additional to the schedule, shall be made each month of 2% of the bill for service provided by Utility at 2,400 volts or 4,160 volts (9) Payment of Charges The foregoing rates are net Payment becomes delinquent 25 days after the billing date (10) Contract Period All contracts under this schedule shall day and generally will not, in the aggregate, amount to more than 400 hours in any period of 6 consecutive months Service under this provision requires monitoring and direct control of all loads by the Light and Power Utility Load Dispatcher Approved independent metering, suitable control equipment, and communication services shall be provided by the customer The 75, minimum provi- sion of the past 11-month high billing demand will not apply to this service In addition to the charges computed in accordance with the uninterrup- tible provisions of this rate, the interruptible customer shall pay a penalty of three (3) times the on-peak Billing Demand for each month in which said customer either ( 1 ) fails to shut down his interruptible load for any reason, including cus- tomer equipment failures or communications system failures, or (ii ) the customer resumes operation of said interruptible load prior to notice by the Light and Power Utility that said operation may be resumed Interruptible service contracts between the customer and the Light and Power Utility and/or the Utility's power supplier will be re- quired where modification of the provisions in- cluded herein are necessary to meet customer and utility constraints By making application for interruptible service, the customer waives all liability of the Light and Power Utility and the Utility' s power supplier at the end of any billing period upon ten day' s written notice to the City Under this schedule the Utility will own, install , operate and maintain standard area lighting equip- ment Materials, installation and associated line extension costs shall be paid by the customer to the Utility Upon termination of service to lights installed after January 1, 1980, the salvage value of recoverable materials less removal expenses will be refunded to the consumer The lamps shall be controlled by automatic control equipment and burning time shall be from approxi- mately thirty minutes after sunset to approximately thirty minutes before sunrise The customer shall notify the Utility of any operational failure of the lamp Lamp replacements or repairs will be performed only during regular working Monthly Rate Fixed charge, per account $39 20 Charge, per kilowatt-hour $ 03031 Equipment rental charges, when applicable, will be determined by cost analysis by the Utility Service extensions and signal installations made by the Utility shall be paid for by the City General Fund, subject to material and installation costs at the time of installation (4) Payment of Charges Bills for traffic signal energy consumption and equipment rental shall be rendered by the Light and Power Utility and paid by the City at the end of each month Monthly billings shall be bsed on the inventory of suburban fringe (2) Applicability This schedule applies to Cogeneration and Small Power Production facilities of 100 kilowatts or less oper- ated in parallel with the Utility' s electric system at the established secondary voltage of the distribution system and having three phase generators This schedule may also apply to generators of single-phase electric energy with the approval of the Utility Terms under which qualifying Facilities may provide capacity in excess of 100 kW to the Utility shall be established by separate contract (3) Monthly Rate A RANDOM POWER GENERATION Administrative Seller If Seller requires supplemental or standby services from the Utility, Seller shall enter into separate electric service contract arrangements with the Utility in accordance with the Utility' s applicable electric service sche- dules If the Seller receives such service, there shall be no interconnection between the system served and the Seller's facility beyond the Utility' s point of delivery (6) Service Charge There shall be a service charge of $11 00 for the processing of a request for Parallel Generation under this schedule except where the request is made for after hours service, in which case the service charge shall be $70 00 The service charge is further applicable for a special meter reading and/or frac- tional period billing (7) Land Rights Seller hereby grants to the Utility for the term of this agreement all necessary rights-of-way and ease- ments to install , operate, maintain, replace and remove the Utility' s metering and other Special Facilities and agrees to execute such other qrants, deeds or documents as the Utility may require to enable it to record such rights-of-way and easements If any part of the Utility' s facilities are to be installed on property owned by other than Seller, Seller shall , without cost to the Utility, procure from the owners thereof, all necessary permanent -30- rights-of-way and easements for the construction, operation, maintenance and replacement of the Uti- lity's facilities upon such property in a form satis- factory to the Utility (8) Facilities and Equipment Design and Construction Seller shall design, construct, install, own, operate and maintain the Facility and all equipment needed to generate and deliver energy and capacity except for any Special Facilities constructed, installed and maintained by the Utility The Facility and equip- ment shall meet all requirements of applicable codes and all standards of Prudent Electrical Practice and the requirements of the Utility Seller shall submit all its Facilities and equipment specifications to the Utility for review and approval prior to connect- ing its Facility and equipment to the Utility' s system The Utility' s review of Seller's specifica- tions shall not be construed as confirming nor endors- ing the design nor as any warranty of safety, durabil- ity or reliability of the Facility or any of the equipment Seller agrees that upon demand of the Utility Seller shall change its Facility and equipment to comply with changing requirements of the Utility' s system (9) Interconnection Facility Construction and Meter Installation Seller shall construct, install , own and maintain Interconnection Facilities and System Protection Facilities as required for the Utility to receive energy and capacity from Seller's Facility In the event it is necessary for the Utility to install Special Facilities or to reinforce its system for purposes of receiving Seller's energy and capacity, Seller shall pay to the Utility the estimated cost of such Special Facilities as a non-refundable contribu- tion in aide of construction prior to the start of construction The Utility shall provide, install and maintain meters at a mutually agreed upon designated location to measure the integrated demand and kilo- watt-hours For firm power generation such metering shall record and indicate the integrated demand for each 30-minute period and shall measure kilowatt- hours Meters for measure of reactive volt-ampere hours may be required by the Utility if deemed appro- priate All meter equipment, installation, owner- -31- ship and administration costs thereof shall be born by Seller, including costs incurred by the Utility for inspecting and testing such equipment as appropriate (10) Facility and Equipment Operation and Maintenance Seller shall operate and maintain its Facility and equipment according to Prudent Electrical Prac- tices and shall generate or otherwise supply such reactive power as may be reasonably necessary to maintain voltage levels and reactive support to the system If Seller is unable or unwilling to provide such reactive power, the Utility may do so at Seller's expense (11) Point of Delivery Seller shall deliver the energy and capacity at the load side of the electric meter or the load side of the main disconnect where instrument trans- formers are employed or as otherwise designated by the Utility (12) Meters All meters used to determine the billing hereunder shall be sealed and the seals shall be broken only upon occasions when the meters are to be inspected, tested or adjusted The Utility shall, at Seller's expense, inspect and test all meters upon their installation and at least once every two years there- after If requested to do so by Seller, the Utility shall inspect or test a meter more frequently than every two years, but the expense of such inspection or test shall be paid by Seller (13) Billing Capacity The Billing Capacity for any month shall be the arithmetic mean of (a) the Measured Capacity for the current month and (b) the lowest Measured Capacity delivered during the preceding twelve months ended with such month (14) Billing The Utility shall send a statement to Seller on or after the 20th day of the monthly billing pe- -32- riod showing the monthly Billing Capacity and energy delivered to the Utility during the previous monthly billing period Seller shall use this statement to compute charges for energy and capacity delivered to the Utility Seller shall then send a monthly billing statement to the Utility which states the energy and capacity charges and a credit equal to the adminis- trative charge, all as applied to the pre-selected Monthly Rate for Random or Firm Power Generation (15) Payment The Utility shall make payment to Seller on or before the 25th day after the billing statement is received by the Utility (16) Changes in Capacity Rating The Seller shall advise the Utility of any proposed changes in its Facility or its Capacity Rating prior to making such changes (17) Discontinuity of Deliveries The Utility shall not be obligated to accept, and the Utility may require Seller to curtail , interrupt or reduce, deliveries of energy and capacity under the following circumstances (a) in order to construct, install , maintain, repair, replace, remove, investi- gate or inspect any of the Utility' s equipment or any part of the Utility' s system, (b) if the Utility determines that curtailment, interruption or reduction is necessary because of emergencies, forced outages, operating conditions on its system, adverse affects upon electric service to other customers of the Utility, or (c) otherwise required by Prudent Electri- cal Practices No new kW ratchet value shall be established and no billing adjustments sh a 1 be made because of such discontinuance of deliveries (18) Indemnity The Seller shall indemnify the Utility, its officers, agents, and employees against all loss, oam age, expense, and liability to third persons for injury to or death of person or injury to property, proximately caused by the Seller ' s construction, ownership, operation, or maintenance of, or by failure of any -33- of Seller's works or facilities used in connection with applicable contract schedules The Seller shall pay all costs that may be incurred by the Utility in enforcing this indemnity (19) Liability Nothing in this schedule shall be construed to create any duty to, any standard of care with reference to or any liability to any person not a Party to this contract schedule The Utility shall not be liable for damages caused to the facilities of the Seller by reason of the opera- tion, faulty operation, or nonoperation of the Utility' s facilities (20) Contract Period and Rate Selection All contracts under this schedule shall select Monthly Rate A, Random Power Generation, or Monthly Rate B, Firm Power Generation and such rate shall be for a minimum period of 90 days unless Parallel Generation service under this schedule is terminated following ten days written notice to the Utility (21) Rules and Regulations Seller must comply with all provisions of the Electric Service Rules and Regulations deemed applicable by the Utility Reference in such Rules and Regulations to the "consumer" or "user" shall be interpreted as being interchangeable with "Qualifying Facility" and "Sel- ler" N Electric Rates General Service Rules and Regulations The rules and regulations applicable to electric service and persons receiving electric service from the City of Fort Collins shall be such rules and regulations as are adopted by the Department of Municipal Public Utilities I and approved by resolution of the Council of the City of Fort Collins Upon such adoption and approval , all such rules and regulations shall be in full force and effect and shall apply to any person, corporation, or c.her entity receiving electric service from the City i -34- 0 Definitions For the purposes of §112-118, the following terms shall have the meanings indicated After Hours -- Those hours between 4 00 p m and 8 00 a m on ay through Friday and holidays Capacity Ratin -- The generator nameplate rating of the Qualifying acility' s equipment diminished by any anticipated losses between such equipment and the Delivery Point Cogeneration -- Facilities which simultaneously produce two forms of useful energy, such as power and steam through the sequential use of energy Such Facilities must be owned by a person not primarily engaged in the generation or sale of electric energy Facility -- That generator and associated equipment owned by a party other than the Utility which is used to generate electric power for sale to the Utility Firm Power Generation -- A Qualifying Facility which offers electrical energy of sufficient reliability and with sufficiently legally enforceable guarantees of deliverability to permit the Utility to reduce firm power purchases from its supplying utility Interconnection Facilities -- All facilities required to e installed so e y to Interconnect and deliver power from Seller's generation to the Utility's system includ- ing but not limited to connection, transformation, switching, metering, safety equipment and System Pro- tection Facilities Interconnection Facilities shall also include any necessary additions and/or reinforce- ments by the Utility to the Utility's system Intermittent Loads -- An electrical demand of an inter- mittent or uctuating character or which reflects frequent starting with high current in-rush Interruptible -- Power made available under agreements which permit curtailment or cessation of delivery by the Utility Parallel Generation -- The operation of Qualifying Facilities when interconnected with the Utility system in accordance with the provisions of applicable sche- dules -35- Prudent Electrical Practices -- Those practices, methods an equipment, as c ange rom time to time, that are commonly used in prudent electrical engineering and operations to operate electric equipment lawfully and with safety, dependability, efficiency and economy Qualif ing Facility or Seller -- A cogeneration or small power production facility which meets the defini- tions of such facilities as defined herein and which is a qualifying facility under Subpart B of Section 201 of the Public Utilities Regulatory Policy Act of 1978 as may be amended from time to time Random Power Generation -- Generators and Facilities that furnish sporadic, noncontinuous, uncertain energy output without reserve capacity and/or which provides power to the Utility at the Sellers discretion or on an as-available basis Small Power Production -- Facilities which derive more than 50 of total energy input from biomass, waste, or renewable resources, including wind, solar and water, to produce electric power Such Facilities must be of less than 80 megawatts capacity and must be owned by a person not primarily engaged in the generation or sale of electric energy Special Facilities -- Interconnection Facilities fur- nished y the Utility at Seller's reques, or because such facilities are necessary additions and/or rein- forcements to the Utility's system Special Meter Readin and/or Fractional Period Billing -- meter rea ng or 11 !ng per ormed at the request of the consumer in addition to the normal monthly meter reading or billing System Protection Facilities -- The equipment required to protect the Utility's system and its customers from faults occurring at
