OF CERTAIN SPECIFIED SIDED ALKS WITHId THE CITY
OF FORT COLLINS AND PROVIDING FOR THE PAYMENT
AND COLLECTION THEREOF
WHEREAS, heretofore, by Ordinance No 41, 1980, duly adopted by the
Council of the City of Fort Collins, tnere sere specified sidewalks in
certain areas of the City in need of repair or reconstruction to meet
minimal standards of safety in order to protect the public, and
WHEREAS, by Ordinance No 41, 1980, the Council of the City of Fort
Collins did order the repair or reconstruction of said sidewalks all in
accordance with Sections 95-39 through 95-47 of the Code of the City of
Fort Collins, and
WHEREAS, pursuant to said ordinance, said repair and reconstruction
has been completed and accepted by the City of Fort Collins, and
WHEREAS, upon the completion of said reoairs or reconstruction, the
City Engineer did, on December 16, 1960, make a report to the City Council
showing the total cost of work done, including an additional ten percent
(10%) to cover the cost of engineering and other incidentals, and
WHEREAS, the City Council has adopted the report of the City Engineer
respecting the cost of such repairs or reconstruction and the schedule of
assessments as prepared by the City Engineer, and
WHEREAS, a copy of the pertinent portions of such report has been
mailed by the City Engineer to each property owner involved ano the City
Clerk has published notice of said report and scneduled a hearing thereon,
and
WHEREAS, December 16, 1980 was the date set for the hearing of com-
plaints and objections and the determinations of the same, and
WHEREAS, on December 16, 1980, the Council of the City of Fort Collins
held a public hearing for said purposes and all complaints and objections
raised at said hearing or filed it writing by property owners within the
subject areas have been considered by the City Council

Section 1 The cost of trle repair and reconstruction of the various
sidewalKS within the specified areas Known as Sioeialk Repair District n7,
including the cost of engineering and other incidentals, is hereby assessed
upon the real estate in said areas in accordance with the provisions of
Section 95-43 of the Code of the City of Fort Collins and the proportion of
said costs assessed upon each applicable lot or tract of land in said area
shall be as follows

Section 2 All assessments herein provided for shall be due and
payable within sixty (60) days after final passage of this ordinance,
without demand, and, if unpaid at the conclusion of said sixty (60) days
shall be certified to the County Treasurer for collection From and after
the date of final passage of this ordinance, the costs assessed shall
be a lien against the lands so assessed and shall bear interest at the rate
of six percent (6%) per annum
Section 3 Payment of any amount assessed, together with accrued
interest thereon may be made to the Director of Finance at any time
prior to the date set forth certifying the assessment to the County Trea-
surer Such unpaid assessments as are certified to the County Treasurer
shall be collected by said County Treasurer together with a ten percent
(10/) penalty thereon to defray the cost of collection as provided by the
laws of the State of Colorado
Introduced, considered favorably on first reading and ordered pub-
lished this 16th day of December , 1980, and to be presented for final
passage on the 6th day o January 1 8
