HomeMy WebLinkAbout056 - 05/18/1982 - ADOPTING A MODEL TRAFFIC CODE, 1977 EDITION ORDINANCE NO 56, 1982 OF THE COUNCIL OF THE CITY OF FORT COLLINS BEING AN ORDINANCE ADOPTING A MODEL TRAFFIC CODE NAMELY, THE "MODEL TRAFFIC CODE FOR COLORADO MUNICIPALITIES" , 1977 EDITION, PROVIDING FOR THE REGULATION OF TRAFFIC, PROVIDING PENALTIES FOR VIOLATION THEREOF AND REPEALING AND RE-ENACTING CHAPTER 114 OF THE CODE OF THE CITY OF FORT COLLINS BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS Section 1 Adoption of the Model Traffic Code for Colorado Munici- palities, 1977 Edition Pursuant to Section 7, Article II of the Charter of the City of Fort Collins and the laws of the State of Colorado, there is hereby adopted by reference Articles I-XXVI, inclusive of the 1977 Edition of the "Model Traffic Code for Colorado Municipalities," promulgated and published as such by the State Department of Highways, 4201 East Arkansas Avenue, Denver, Colorado, 80222 The subject matter of the Model Traffic Code relates primarily to comprehensive traffic control regulations for the City of Fort Collins The purpose of this ordinance and the Code adopted herein is to provide a system of traffic regulations consistent with State law and generally conforming to similar regulations throughout the State and the Nation Three copies of the Model Traffic Code adopted herein are now filed in the Office of the Clerk of the City of Fort Collins, Colorado, and may be inspected during regular business hours The 1977 Edition of the Model Traffic Code is adopted as if set out at length and from the date on which this ordinance shall take effect, the provisions thereof shall be controlling within the limits of the City of Fort Collins Section 2 Amendments The following articles, sections, divisions, subsections, appendices or parts thereof of the Model Traffic Code as herein adopted are hereby amended, except as noted, to read as follows Section 2-2 Entering Through Highway - Stop or Yield ntersection (c) Where stop signs have been erected on all corners at an intersection, the first vehicle arriving at the intersection shall , after having stopped, have the right-of-way, and when two vehicles have arrived at an intersection from different streets at approximately the same time, the driver of the vehicle on the right, having first stopped, shall have the right of way Section 4-1 Basic Rule (a) No person shall drive a vehicle on a street or highway within this municipality at a speed greater than is reasonable and prudent under the conditions existing and in no event greater than 55 miles per hour (b) Except when a special hazard exists that requires lowering speed and except as otherwise provided pursuant to Subsection C hereof, the following speed limits are hereby established, and no person shall drive a vehicle in excess of such limits 1 In all school zones with signs erected and posted giving notice thereof, the speed limit shall be twenty miles per hour 2 In all alleyways the speed limit shall be fifteen miles per hour 3 On the campus of Colorado State University, the speed limit shall be twenty miles per hour unless signs are posted giving notice otherwise, in which event the posted speed shall control 4 On all other streets of the City not speci - fically posted, the applicable speed limit shall be twenty-five miles per hour (c) The Traffic Engineer, pursuant to Section 23-9, may establish speed limits different from those established herein and, upon posting such limits, the posted speed shall control and it shall be unlawful for any person to drive or operate a motor vehicle in excess of such posted limit Section 12-2 Obedience to Stopping , Standing or -Parking egu ations (b) No person shall park or direct another person to park a vehicle in a block face for a period in excess of a time restriction established for parking in the block face, regardless of the movement of the vehicle from various parking locations in the block face -2- Section 12-3 Parking Privilege for the Handicapped (b) A handicapped person may park in a parking space identified by an official sign as being reserved for use by the handicapped whether on public property or other property available for public use A placard or license plate issued to a handicapped person shall be displayed on the vehicle while parked in such space (c) The owner of private property available for public use may install official signs identifying parking spaces reserved for such use by the handicapped Such installation shall be at the owner' s expense and in compliance with the Manual for the Uniform Traffic Control Devices Such installation shall be a waiver of any objection the owner may assert concerning enforcement of this section (d) It is unlawful for any person other than a handi- capped person to park in a parking space on public or private property which is clearly identified by an official sign as being reserved for use by the handi- capped unless such person is parking the vehicle for the benefit of a handicapped person Section 16-5 Crossing and Yielding at Other Than Crosswalks (c) DELETE Section 17-6 Inspection of Bicycles DELETE Section 18-10 Vehicles Weighed , Excess Removed (a) Any police officer having reason to believe that the weight of a vehicle and load is unlawful is authorized to require the driver to stop and submit to a weighing of the same either by means of portable or stationary scales and shall require that such vehicles driven to the nearest public scales in the event such scales are within ten (10) miles -3- Section 20-6 Limitations on Backing The driver of a vehicle may back the same anywhere within this municipality other than on a controlled access roadway only when such movement is made without interfering with other traffic which is so close to constitute an immediate hazard Section 22-20 Authority to Impound Vehicles (c) If the owner of a vehicle does not respond to a notice sent to him by the Clerk of the Court or Traffic Violations Bureau pursuant to Section 22-13 hereof and any police officer finds such vehicle standing upon any portion of a street or alley right of way within this municipality , then such police officer is au- thorized to immobilize such vehicle by installing on or attaching to such vehicle a device designed to restrict the normal movement of the vehicle, provided that such police officer shall attach to the vehicle a notice in writing advising the owner, driver or person in charge of the vehicle that the vehicle was immobilized because of failure to respond to a notice regarding illegal parking and that release from such immobilization may be obtained by contacting the Police Department and arranging for the payment of all fines or other penal- ties applicable to such vehicle, including the charge established by the court for immobilizing the vehicle (d) No vehicle which has been immobilized pursuant to this section shall be moved by any person without first obtaining a release from such immobilization from the Police Department, nor shall any person deface, injure, tamper with, open or willfully break, destroy or impair the usefulness of any immobilization device attached to a vehicle pursuant to this section or remove or attempt to remove said device from such vehicle Section 25-3 Definitions Relating to Streets and Highways ( t) Block Face - A portion of a street or highway between two intersections , including all on-street parking within such boundaries Section 25-5 Miscellaneous Definitions W Prima Facia Speed Limit DELETE -4- e Section 3 Penalties The following penalties herewith set forth in full , shall apply to this ordinance A It is unlawful for any person to violate any of the provi- sions of the Model Traffic Code stated or adopted in this ordinance B Every person convicted of a violation of any provision of the Model Traffic Code stated or adopted in this ordinance shall be punished by a fine not exceeding three hundred dollars, or by imprisonment not ex- ceeding ninety days, or by both such fine and imprisonment Section 4 Application This ordinance shall apply to every street, alley, sidewalk area, driveway, park, and to every other public way or public place or public parking area, either within or outside the corporate limits of this munici- pality, the use of which this municipality has jurisdiction and authority to regulate The provisions of Sections 5-1 , 5-2 , 15-12 , 20-6, 21-13 and 23-3 of the adopted Model Traffic Code, respectively concerning reckless driving, careless driving, unauthorized devices, limitations on backing, eluding an officer and accident investigation shall apply not only to public places and ways but throughout this municipality Section 5 Validity If any part or parts of this ordinance are for any reason held to be invalid such decision shall not affect the validity of the remaining portions of this ordinance The Council of the City of Fort Collins hereby declares that it would have passed this ordinance and each part or parts thereof, irrespective of the fact that any one part or parts be declared invalid Section 6 Repeal All sections of Chapter 114 of the Code of the City of Fort Collins covering the same matters as embraced in this ordinance are hereby repealed and all ordinances or parts of ordinances inconsistent with the provisions of this ordinance are hereby repealed, except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the effective date of this ordinance Section 7 Interpretation This ordinance shall be so interpreted and construed as to effectuate its general purpose to conform with the State' s uniform system with for the regulation of vehicles and traffic Article and section headings of the ordinance and adopted Model Traffic Code shall not be deemed to govern, limit, modify or in any way affect the scope, meaning or extent of the provisions of any article or section thereof -5- J Section 8 Certification The City Clerk of the City of Fort Collins shall certify to the passage of this ordinance and make not less than three copies of the adopted Model Traffic Code available for inspection by the public during regular business hours Introduced, considered favorably on first reading, and ordered pub- lished this 4th day of May , A D 1982 , and to be presented for final passage on the 18th day of May _, A D , 1982 Mayor ATTEST "yf\ _V""" .
