ORDINANCE NO 83, 1982
OF THE COUNCIL OF THE CITY OF FORT COLLINS
BEING AN ORDINANCE VACATING A PORTION OF AN ALLEY
IN INDIAN HILLS SUBDIVISION, FIFTH FILING
WHEREAS, the Council of the City of Fort Collins has been petitioned
to vacate a portion of an alley in Indian Hills Subdivision, Fifth Filing,
as more particularly described below, and
WHEREAS, said alley is not presently needed as an alley or roadway,
and
WHEREAS, it appears that the rights of the residents of the City of
Fort Collins will in no way be prejudiced or injured by the vacation of
said alley, provided that there is reserved unto the City an easement for
maintenance and placement of utilities in said easement
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS, that a portion of the alley in Indian Hills Subdivision, Fifth
Filing, more particularly described as follows, to wit
A ten foot alley adjacent to the west lot line of Lot
85, Indian Hills Subdivision, Fifth Filing, City of
Fort Collins, County of Larimer, State of Colorado
be, and the same hereby is, vacated, abated and abolished except that there
is reserved unto the City of Fort Collins, an easement for maintenance and
placement of utilities (both existing and future) and the right of ingress
and egress thereto
Introduced, considered favorably on first reading and ordered pub-
lished this 20th day of July, 1982, and to be presented for final passage
on the 3rd day of August, 1982
