HomeMy WebLinkAbout041 - 05/05/2009 - AUTHORIZING THE LEASE OF CITY-OWNED PROPERTY AT 400 WOOD STREET FOR UP TO FIFTEEN YEARS ORDINANCE NO. 041, 2009 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE LEASE OF CITY-OWNED PROPERTY AT 400 WOOD STREET FOR UP TO FIFTEEN YEARS WHEREAS,the City is the owner of the property legally described as Lots 25 and 26, Block 294, West Side Addition, Fort Collins, located at 400 Wood Street, Fort Collins, Colorado (the "Property"); and WHEREAS, the Property was purchased with Community Development Block Grant ("CDBG") funding; and WHEREAS, on August 17, 2004, the City Council approved Ordinance No. 122, 2004, authorizing the lease of the Property in a manner consistent with CDBG objectives; and WHEREAS, Foothills Gateway, Inc., has leased the property for the past five years for the principal purpose of providing relief to Larimer County parents and host families of adults with developmental disabilities; and WHEREAS, City staff wishes to continue to lease the Property to Foothills Gateway for up to fifteen more years; and WHEREAS, Foothills Gateway's use of the City Property has advanced important human services objectives of the City and CDBG by benefitting low-income residents of Fort Collins; and WHEREAS,the proposed lease agreement would provide for a five-year lease term with the option of two five-year renewal terms,in exchange for payment of nominal rent in the amount of$25 per year and compliance with certain conditions and restrictions to be set forth therein; WHEREAS,pursuant to Section 23-111(a)of the City Code,the City Council is authorized to sell, convey or otherwise dispose of any and all interests in real property owned in the name of the City, provided that the City Council first finds, by ordinance,that such sale or other disposition is in the best interests of the City. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: - Section 1. That the proposed lease of the Property at 400 Wood Street to Foothills Gateway, Inc., is in the best interests of the City. Section 2. That the City Manager is hereby authorized to execute a lease agreement for the Property, consistent with the terms of this Ordinance, together with such additional terms and conditions as the City Manager, in consultation with the City Attorney, deems necessary and appropriate to protect the interests of the City or to effectuate the purposes of this Ordinance, including, but not limited to,any necessary changes to the legal description of the Property,so long as such changes do not materially increase the size or change the character of the property to be leased.
