AMENDING SECTION 112-66 OF THE CODE OF THE CITY
OF FORT COLLINS PERTAINING TO THE RAW WATER
REQUIREMENTS OF THE CITY
WHEREAS, Section 112-66 of the Code of the City presently requires the
furnishing of raw water by developers of lands within the City of Fort
Collins prior to the furnishing of potable water therefor by the City;
and
WHEREAS, the present raw water requirements of the City are based upon
an acre foot volume of water per acre of land to be developed; and
WHEREAS, the Council of the City of Fort Collins has determined that
the present acre foot requirements of the City for the furnishing of raw
water may be insufficient to adequately compensate the City for the actual
water usage of a development requiring water service in certain circum-
stances; and
WHEREAS, for the foregoing reasons, and having received the favorable
recommendation of the Water Board, the Council of the City of Fort Collins
does hereby determine that it is necessary and appropriate, for the
protection of the raw water resources of the City of Fort Collins, that
Section 112-66 of the Code of the City of Fort Collins be amended to add an
additional subsection which would require the furnishing of raw water
to adequately compensate the City for the actual water usage of a develop-
ment requiring water service.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF, FORT
COLLINS that Section 112-66 of the Code of the City of Fort Collins be,
and it hereby is, amended by the addition of the following:
E. Notwithstanding the requirements as provided in para-
graphs (A) and (B) above, in the event that the Director
of Water Utilities shall determine that said require-
ments are inadequate to compensate the City for the
actual water usage of a development requiring water
service, then the Director shall determine the volume of
raw water that shall be necessary to so compensate
the City, and require the furnishing thereof.
Introduced, considered favorably on first reading, and ordered pub-
lished this 4th day of October, A.D. 1983, and to be presented for final
passage on the 18th day of October, 1983.
