OF THE COUNCIL OF THE CITY OF FORT COLLINS
AMENDING CHAPTER 82, ARTICLE. 2
OF THE CODE OF THE CITY OF FORT COLLINS
RELATING TO EXPENDITURES MADE FROM THE
PARK ACQUISITION FUND .
WHEREAS, the City of Fort Collins Park Acquisition Fund was created by
Ordinance No. 38, 1968 of the Council on September 26, 1968, in Section
82-2 of the Code of the City of Fort Collins; and
WHEREAS, Section 82-2 of the Code was amended on September 7 , 1972, by
Ordinance No. 55, 1972, to allow the moneys in such Fund to be spent on the
development of park lands as well as the acquisition of park lands; and
WHEREAS , on April 15 , 1980 , the Council passed Resolution 80-49
adopting policies relating to the Fund, the implementation of which neces-
sarily causes certain administrative costs to arise which costs are not
specifically listed as authorized expenditures from the Fund in Section
82-2; and
WHEREAS, on May 17, 1983, by Ordinance No. 56, 1983, the Council
appropriated moneys from the Fund to a new Park Equipment Replacement
account, which account is not specifically listed as an authorized expendi-
ture from the Fund in Section 82-2; and
WHEREAS, it is in the best interest of the citizens of the City of
Fort Collins that expenditures for administrative costs related to park
lands, park site equipment, both new and replacement, and plantings be
specifically included as authorized expenditures from the Fund.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that Section 82-2 (Park Acquisition Fund) 'of the Code of the City
of Fort Collins be, and the same hereby is, repealed and readopted as
follows:
§82-2 Parkland Fund.
There is hereby created a fund for the acquisition,
development and administration of park lands pursuant
to the authority contained in Article V, Section 27 of
the Charter of the City of Fort Collins. Into such
fund shall be deposited all moneys collected pursuant
to the provisions of this chapter and the moneys in
such fund shall be expended solely for the purposes of
acquiring, developing and administering park lands in
such manner as shall be directed by the City Council of
the City of Fort Collins. Expenditures for the devel-
opment of park lands may include purchases of new or
replacement park site equipment and plantings.
Introduced, considered favorably on first reading, and ordered pub-
lished this 16th day of August, A.D. 1983, and to be presented for final
passage on the 6th day of September, A.D. 1983.
