HomeMy WebLinkAbout110 - 09/04/1984 - ANNEXING THE SECOND FISHER-LEMAY AVENUE ANNEXATION ORDINANCE NO. 110, 1984 OF THE COUNCIL OF THE CITY OF FORT COLLINS ANNEXING PROPERTY KNOWN AS THE SECOND FISHER-LEMAY AVENUE ANNEXATION TO THE CITY OF FORT COLLINS, COLORADO WHEREAS, Article II, Section 30 of the Constitution of the State of Colorado requires that one of the following conditions be met before an unincorporated area be annexed to a municipality: 1. The question of annexation be submitted to a vote of the landowners and registered electors of the area to be annexed and the majority of such persons voting, vote in favor of annexation ; or 2. The annexing municipality receive a petition for annexation signed by more than 50% of the landowners in the area who own more than 50% of the land; or 3. The area to be annexed be entirely surrounded by or be solely owned by the annexing municipality; and WHEREAS, 100% of the landowners in the Second Fisher-Lemay Avenue Annexation area have signed a petition for annexation; and WHEREAS, not less than one-sixth (1/6th) of the perimeter of the area to be annexed is contiguous with the City of Fort Collins and a community of interest exists between the territory to be annexed and the City of Fort Collins ; and the territory to be annexed is urban or will be urbanized in the near future; and such territory is integrated or is capable of being integrated with the City of Fort Collins ; and WHEREAS, no election is required and no additional terms and condi- tions are to be imposed in connection with this annexation ; and WHEREAS, the Council has found and determined and does hereby find and determine that said petition is in substantial compliance with the annexa- tion laws of the State of Colorado and that the territory is eligible for annexation, and the City Council desires to annex the same to the City of Fort Collins ; and NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS: Section 1. That the following described property A tract of land located in the Southwest quarter of Section 7, Township 7 North, Range 68 West, of the 6th P.M. of Larimer County, Colorado, being more particu- larly described as follows: Considering the South line of the Southwest quarter of said Section 7 as bearing North 89°23'00" East and with all bearings contained herein relative thereto: Commencing at the Southwest corner of said Section 7: thence , along the said South line, North 890 23 00 East, a distance of 329.35 feet ; thence North 00°49' 51" West a distance of 69.36 feet to the intersection of the North right-of-way line of Colorado State Highway 14 and the East right-of-way line of Lemay Avenue ; thence along said East right-of-way line of Lemay Avenue North 01°56' 06" East, a distance of 155.00 feet to the Point of Beginning; thence South 89°38'00" East a distance of 50.00 feet ; thence South 01056'06" West ; a distance of 104.98 feet ; thence South 89°38'00" East a distance of 389.07 feet ; thence South 00°22'00" West a distance of 50.00 feet to the North right-of-way line of Colorado State Highway 14; thence along said North right-of-way line the following two (2) courses and distances ; (1) South 89°38'00" East, a distance of 205.07 feet , (2) thence 97.06 feet along a curve concave to the South, having a central angle of 00028' 48" , a radius of 11585.00 feet, and a chord which bears South 89°23' 36" East, a distance of 97.06 feet ; thence to the East line of the parcel described in Book 1701 at Page 990 as recorded in the Office of the Clerk and Recorder of said County; thence along said east line the following two (2) courses and distances; (1) 32.75 feet along a curve concave to the Southwest, having a central angle of 40°34' 18" , a radius of 46.25 feet, and a chord which bears North 19°55' 17" West, a distance of 32.07 feet; (2) 32.75 feet along a curve concave to the Northeast , having a central angle of 40°34' 26" , a radius of 46.25 feet, and a chord which bears North 19055'13" West a distance of 32.07 feet; thence con- tinuing along said east line, and its northerly pro- longation, and along the west line of that parcel of land as described in Book 1941 at Page 172 as recorded in the Office of Clerk and Recorder of said County, North 00°22'00" East 285.34 feet to the North line of said parcel recorded in Book 1941 at Page 172; thence -2- along the said North line South 89'38' 00" East a distance of 206 .05 feet , to the West line of Lot 1, Block 1 of the East Mulberry Subdivision , a sub- division of record in the Office of the Clerk and Recorder of said County; thence along said West line Lot 1, Block 1 and along the West line of that parcel of land as described in Book 1983 at Page 991 as recorded in the Office of the Clerk and Recorder of said County, North 00°24'00" East a distance of 447.65 feet ; thence leaving said west line North 88°03'54" West a distance of 904.59 feet to the said East right- of-way line of Lemay Avenue; thence along said East right-of-way line South 01°56'06" West a distance of 662.81 feet to the True Point of Beginning. Containing 14.678 acres. be, and it hereby is , annexed to the City of Fort Collins and made a part of said City, to be known as the Second Fisher-Lemay Avenue Annexation. Section 2 . That in annexing said territory to the City of Fort Collins , the City of Fort Collins does not assume any obligation respecting the construction of water mains , sewer lines, gas mains, electric service lines , streets or any other services or utilities in connection with the territory hereby annexed except as may be provided by the ordinances of the City of Fort Collins . Section 3. That within ninety (90 s from the date this Ordinance ) days becomes effective, no building permit shall be issued for any of the lands herein described unless said lands have been zoned under the zoning ordi - nances of the City.
