ORDINANCE NO. 69 , 1984
OF THE COUNCIL OF THE CITY OF FORT COLLINS
REPEALING ARTICLE III OF CHAPTER 73 OF THE
CODE OF THE CITY OF FORT COLLINS PERTAINING TO
JUNK DEALERS AND DESIGNATING ARTICLE III
OF CHAPTER 73 AS A RESERVED ARTICLE
WHEREAS, in 1959 the Council of the City of Fort Collins adopted
Article III of Chapter 73 of the Code of the City of Fort Collins which
provides for the licensing and bonding of junk dealers; and
WHEREAS, Article III of Chapter 73 also requires every person so
licensed to keep detailed records of all purchases except rags and bottles;
and
WHEREAS, nearly all businesses intended to be regulated by the provi-
sions of said Article III are no longer doing business in the City; and
WHEREAS, the relatively new business of recycling resources is also
regulated by the provisions of said Article III; and
WHEREAS, such licensing, bonding and record keeping as required by
said Article III is unreasonably burdensome and is contrary to the City
supported concept of recycling resources; and
WHEREAS, the rights of the residents of the City of Fort Collins will
in no way be injured by the deletion of Article III of Chapter 73 of the
Code of the City of Fort Collins.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That Article III of Chapter 73 of the Code of the City of
Fort Collins be, and the same hereby is, repealed.
Section 2. That Article III of Chapter 73 of the Code of the City of
Fort Collins be, and it hereby is, designated a reserved article.
Introduced, considered favorably on first reading and ordered pub-
lished this 5th day of June, A.D. 1984, and to be presented for final
passage on the 3rd day of July, A.D. 1984.
