VACATING AN ACCESS EASEMENT LOCATED ON
LOTS 16, 17 AND 31 OF BLOCK 2
IN THE WOODLANDS PUD, FILING 3
WHEREAS, the Council of the City of Fort Collins has been petitioned
to vacate an access easement located on Lots 16, 17 and 31 of Block 2 in
the Woodlands PUD, Filing 3, set forth in more particular below; and
WHEREAS, petitioners feel that a sidewalk in this location would be a
maintenance and liability problem; and
WHEREAS, staff has reviewed the request and feels the area is suffi-
ciently served by the walks adjacent to the street and recommends vacation
of said easement; and
WHEREAS, a replacement easement for utilities has been received from
Stonybrook North, Inc.; and
WHEREAS, the rights of the residents of the City of Fort Collins will
in no way be prejudiced or injured by said vacation.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that that certain access easement located on Lots 16, 17 and 31 of
Block 2 in the Woodlands PUD, Filing 3, set out in more particular as
follows, to wit:
A 10.00-foot-wide access easement situate in Lots 16, 17
and 31, Block 2, The Woodlands, PUD, Filing 3, Fort
Collins, Colorado, which begins at the N6rthwest corner
of said Lot 16 and run thence along the arc of a 373.00-
foot radius curve to the right, a distance of 10.52
feet, the long chord of which bears N 56°56'15" E 10.52
feet; thence S 15°03'42" E 256.83 feet; thence along
the arc of a 50.00-foot radius curve to the left,
a distance of 10.07 feet, the long chord of which
bears S 80°42' 30" W 10.05 feet; thence N 15003'42"
W 252.57 feet to the point of beginning.
be, and the same hereby is, vacated, abated and abolished.
Introduced, considered favorably on first reading, and ordered pub-
lished this 20th day of March, A.D. 984, and to be presented for final
passage on the 3rd day of April , A. . 1 4.
