OF THE COUNCIL OF THE CITY OF FORT COLLINS
VACATING A PORTION OF A BLANKET EASEMENT OF
THE FOUNTAINHEAD PUD, PHASE III
WHEREAS, the Council of the City of Fort Collins has been petitioned
to vacate a portion of a blanket easement located in the Fountainhead PUD,
Phase III, set forth in more particular below; and
WHEREAS, the original plat of Fountainhead PUD, Phase III shows
building envelopes with all areas outside the envelopes to be a blanket
easement; and
WHEREAS, the requested vacation would allow the construction of a
restaurant requiring a larger building envelope; and
WHEREAS, all affected utilities have been contacted and have no
problems with the vacation; and
WHEREAS, the rights of the residents of the City of Fort Collins will
in no way be prejudiced or injured by said vacation.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that a portion of a blanket easement located in the Fountainhead
PUD, Phase III, set out in more particular as follows, to wit:
Beginning at the Northeast corner of said PUD. Thence along the
North line of said PUD S 89030' 24" W 130.00 feet; thence S
00°29'36" E 70.00 feet to the true point o.f beginning, thence
continuing S 00°29'36" E 23.00 feet; thence N 89030'24" E 80.00
feet; thence N 00029'36" W 65.00 feet; thence N 45°29'36" W 28.28
feet; thence S 89030' 24" W 10.00 feet; thence S 00'29'36"
E 62.00 feet; thence S 89°30'24" W 50.00 feet to the true point
of beginning. Said vacation contains 0.08 acres more or less.
be, and the same hereby is, vacated, abated and abolished.
Introduced, considered favorably on first reading, and ordered pub-
lished this 20thday of March A.D. 1984, and to be presented for final
passage on the 3rd day of April A.D. 984.
