OF THE COUNCIL OF THE CITY-19F FORT COLLINS
AMENDING ORDINANCE NO. 105, 1980 TO CHANGE THE
ZONING CONDITIONS ON THE PROPERTY KNOWN AS
THE DIXON CREEK ANNEXATION
WHEREAS, on August 5, 1980, the Council of the City of Fort Collins
passed, on second reading, Ordinance No. 105, 1980; and
WHEREAS, Ordinance No. 105, 1980 zoned the Dixon Creek Annexation as
R-P, Planned Residential , with a condition limiting density to 8.0 DU/acre;
and
WHEREAS, factors present at the time this condition was placed on the
property have substantially changed as a result of the adoption of the Land
Development Guidance System; and
WHEREAS, the existing condition limiting density to 8.0 DU/acre is an
unnecessary restraint on the development of the property; and
WHEREAS, City staff requested the Planning and Zoning Board to recom-
mend approval to City Council of the request to eliminate the density
limitation and place a new condition on the Dixon Creek Annexation requir-
ing development as a planned unit development; and
WHEREAS, on January 23, 1984, the Planning and Zoning Board voted 5-2
to recommend approval of this request; and
WHEREAS, the owners of the property, C. J. Associates Joint Venture,
understand and concur with the elimination of the density limitation and
the new condition.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that Ordinance No. 105, 1980 be, and it hereby is, amended as
follows:
Section 1. That the density limitation condition of 8.0 DU/acre on
the property known as the Dixon Creek Annexation is eliminated.
Section 2. That the zoning granted herein is expressly conditioned
upon the entire Dixon Creek Annexation being developed as a planned unit
development.
Introduced, considered favorably on first reading, and ordered pub-
lished this 20th day of March, A. 1984, and to be presented for final
passage on the 3rd day of April , D. 984.
