HomeMy WebLinkAbout056 - 04/18/2006 - APPROPRIATING UNANTICIPATED REVENUE IN THE STREET OVERSIZING FUND FOR TRANSFER TO THE CAPITAL PROJEC ORDINANCE NO. 056, 2006 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING UNANTICIPATED REVENUE IN THE STREET OVERSIZING FUND FOR TRANSFER TO THE CAPITAL PROJECTS FUND - TRILBY AND ZIEGLER ROAD IMPROVEMENT PROJECT AND AUTHORIZING THE TRANSFER OF EXISTING APPROPRIATIONS FROM THE STREET OVERSIZING FUND TO THE CAPITAL PROJECTS FUND - TRILBY AND ZIEGLER ROAD IMPROVEMENTS PROJECT TO BE USED TO CONSTRUCT A ROUNDABOUT AT THE INTERSECTION OF ZIEGLER AND KECHTER ROADS WHEREAS, on June 7, 2005, City Council adopted Ordinance No. 61, 2005, appropriating a contribution from the Poudre School District ($692,342) and authorizing the transfer of existing appropriations ($498,113) in the Street Oversizing Fund to the Capital Projects Fund to be used construct improvements on Ziegler Road,adjacent to Kinard Core Knowledge Junior High School, from Kechter Road south to Trilby Road; and WHEREAS,the scope of improvements to the aforementioned project included installation of curb-and-gutter, sidewalks, bike lanes from Kechter Road on the north to Trilby Road on the south, and initial design of roundabout improvements at the intersection of Ziegler and Kechter Roads (the"Project'); and WHEREAS, with the aforementioned improvements to be completed this summer, intersection and arterial improvements associated with Phase II of the Project can commence; and WHEREAS, Phase II improvements will include the widening of Ziegler Road to a minor arterial street standard from its existing two-lane configuration,installation of a 24-inch water main, and the construction of a modern roundabout at the intersection of Ziegler and Kechter Roads; and WHEREAS, on May 3, 2005, City Council adopted Resolution 2005-043, authorizing the construction of a modern roundabout at the crossing of Ziegler and Kechter Roads; and WHEREAS,the estimated cost to construct intersection and arterial improvements associated with Phase II of the Trilby and Ziegler Road Improvements Project is $1,759,552; and WHEREAS, City staff has identified the following sources to be used to fund the Phase II improvements: Contributions - Everett Enterprises Development $ 309,224 Contributions - Fort Collins-Loveland Water District 551,113 Street Oversizing Fund - Existing Appropriations 899,215 Total $ 1,759,552 WHEREAS, upon completion of the bid process, Phase II improvements to the Trilby and Ziegler Road Improvements Project are scheduled to begin in June 1, 2006 and be completed prior to the start of fall classes for the Poudre School District on August 16, 2006; and WHEREAS,Article V, Section 9, of the Charter of the City of Fort Collins(the"Charter") permits City Council to make supplemental appropriations by ordinance at anytime during the fiscal year, provided that the total amount of such supplemental appropriations, in combination with all previous appropriations for that fiscal year, does not exceed the current estimate of actual and anticipated revenues to be received during the fiscal year; and WHEREAS, Article V, Section 10, of the Charter authorizes City Council to transfer by ordinance any unexpended and unencumbered amount or portion thereof from one fund or capital account to another fund or capital project,provided that the purpose for which the transferred funds are to be expended remains unchanged; and WHEREAS, the appropriation of the contributions from Everitt Enterprises Development and the Fort Collins-Loveland Water District as described herein will not cause the total amount appropriated in the Street Oversizing Fund budget to exceed the current estimate of actual and anticipated revenues to be received during any fiscal year; and WHEREAS, it is the desire of City Council to appropriate the sum of $860,337 from contributions within the Street Oversizing Fund,for transfer to the Capital Projects Fund-Trilby and J Y Ziegler Road Improvements Project - Phase II, and to authorize the transfer of existing appropriations,totaling$899,215,in the Street Oversizing Fund to the Capital Projects Fund-Trilby and Ziegler Road Improvements Project - Phase II to be used to construct intersection and arterial street improvements for Ziegler Road, from Kechter Road, south to Trilby Road. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That there is hereby appropriated from unanticipated revenue in the Street Oversizing Fund, the sum of EIGHT HUNDRED SIXTY THOUSAND THREE HUNDRED THIRTY-SEVEN DOLLARS ($860,337) for transfer to the Capital Projects Fund - Trilby and Ziegler Road Improvements Project - Phase II, and appropriated therein, to be used to construct intersection and arterial street improvements for Ziegler Road, from Kechter Road, south to Trilby Road. Section 2. That the unexpended appropriated amount of EIGHT HUNDRED NINETY-NINE THOUSAND TWO HUNDRED FIFTEEN DOLLARS($899,215)is hereby authorized for transfer from the Street Oversizing Fund to the Capital Projects Fund - Trilby and Ziegler Road Improvements Project - Phase II, and appropriated therein, to be used to construct intersection and arterial street improvements for Ziegler Road, from Kechter Road, south to Trilby Road.
