HomeMy WebLinkAbout060 - 04/16/2002 - AUTHORIZING THE ACCEPTANCE OF A DONATION OF 1.524 ACRES OF LAND FROM WATERGLEN, LLC AND APPROPRIATIN ORDINANCE NO. 060, 2002 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE ACCEPTANCE OF A DONATION OF 1.524 ACRES OF LAND FROM WATERGLEN, LLC AND APPROPRIATING UNANTICIPATED REVENUE IN THE NEIGHBORHOOD PARKLAND FUND WATERGLEN PARK PROJECT WHEREAS, the current Parks and Recreation Policy Plan recommends that neighborhood parks be developed at a standard of 2.5 acres per 1,000 population, with a service area for a park typically being one square mile in size and bounded by arterial streets; and WHEREAS,the Waterglen Development is located in the square mile bounded by 1-25,Vine Drive, Timberline Road, and Mountain Vista Drive; and WHEREAS,the Parks and Recreation Department plans to develop a mini-park in this area, primarily to serve the Waterglen Development; and WHEREAS, the developer, Waterglen, LLC, wishes to donate 1.524 acres of land for this park as shown on Exhibit "A", attached hereto and incorporated herein by this reference (the "Property"); and WHEREAS, the value of the Property is estimated to be $30,480; and WHEREAS, the cost to develop the Property into a park is $180,000, which is budgeted in the Neighborhood Parkland Fund in 2002 and 2003,and the annual maintenance funding for the park in the amount of$23,268 is allocated starting in the 2004 budget; and WHEREAS, staff has determined that the donation of the Property by Waterglen, LLC will assist the City in meeting its goals for neighborhood parks; and WHEREAS,Article V, Section 9,of the Charter of the City of Fort Collins permits the City Council to make supplemental appropriations by ordinance at any time during the fiscal year, provided that the total amount of such supplemental appropriations,in combination with all previous appropriations for that fiscal year does not exceed the then current estimate of actual and anticipated revenues to be received during the fiscal year; and WHEREAS, City staff has determined that the appropriation of the donated land, as described herein, will not cause the total amount appropriated in the relevant funds to exceed the current estimate of actual and anticipated revenues to be received in that fund during the fiscal year; and WHEREAS,it is the desire of the Council to authorize the acceptance of the donation of the Property from Waterglen, LLC and to appropriate $30,480 of unanticipated revenue in the form of a donation of land in the Neighborhood Parkland Fund. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the City Council hereby approves and authorizes the acceptance by the Mayor of a deed of conveyance of the Property for park purposes. Section 2. That there is hereby appropriated for expenditure from unanticipated revenue in the Neighborhood Parkland Fund Waterglen Park Project the sum of THIRTY THOUSAND FOUR HUNDRED EIGHTY DOLLARS ($30,480) for Neighborhood Parkland Fund purposes.
