OF THE COUNCIL OF THE CITY_UF FORT COLLINS
ANNEXING PROPERTY KNOWN AS THE
RIVERSIDE-LEMAY ANNEXATION
TO THE CITY OF FORT COLLINS, COLORADO
WHEREAS, Article II, Section 30 of the Constitution of the State of
Colorado requires that one of the following conditions be met before an
unincorporated area be annexed to a municipality:
1. The question of annexation be submitted to a vote of
the landowners and registered electors of the area to
be annexed and the majority of such persons voting,
vote in favor of annexation; or
2. The annexing municipality receive a petition for
annexation signed by more than 50% of the landowners in
the area who own more than 50% of the land; or
3. The area to be annexed be entirely surrounded by or be
solely owned by the annexing municipality; and
WHEREAS, 100% of the landowners in the Riverside-Lemay Annexation area
have signed a petition for annexation; and
WHEREAS, not less than one-sixth (1/6th) of the perimeter of the area
to be annexed is contiguous with the City of Fort Collins and a community
of interest exists between the territory to be annexed and the City of Fort
Collins; and the territory to be annexed is urban or will be urbanized in
the near future; and such territory is integrated or is capable of being
integrated with the City of Fort Collins; and
WHEREAS, no election is required and no additional terms and condi-
tions are to be imposed in connection with this annexation; and
WHEREAS, the Council has found and determined and does hereby find and
determine that said petition is in substantial compliance with the annexa-
tion laws of the State of Colorado and that the territory is eligible
for annexation, and the City Council desires to annex the same to the City
of Fort Collins.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS:
Section 1. That the following described property
A parcel of land situate in the Northeast 1/4 of the
Northeast 1/4 of Section 13, Township 7 North, Range 69
West and the Northwest 1/4 of the Northwest 1/4 of
Section 18, Township 7 North, Range 68 West of the 6th
P.M. , County of Larimer, State of Colorado, being more
particularly described as follows:
Considering the North line of the Northwest 1/4
of said Section 18, as bearing N 89023' E, and with all
bearings contained herein relative thereto: commencing
at the Northwest corner of said Section 18; thence S
00*43' W, a distance of 175.00 feet to the South right
of way line of Colorado State Highway 14; thence along
said South right of way line N 89038' W, a distance of
129.15 feet to a point of beginning; thence S 20045'
40" E, a distance of 84.83 feet; thence S 37*26' E, a
distance of 99.45 feet; thence S 57°24'40" E, a dis-
tance of 44.91 feet; thence S 59018' E, a distance of
143.54 feet; thence N 89015' E, a distance . of 67.00
feet; thence S 84039' E, a distance of 107.20 feet more
or less to the East right of way line of Lemay Avenue;
thence along said East right of way line N 14039'24" E,
a distance of 133.07 feet; thence N 01°45'49" E , a
distance of 133.29 feet more or less to the South right
of way line of Colorado State Highway 14; thence along
said South right of way line S 89038' E, a distance of
280.71 feet; thence S 00°20'52" W, a distance of 289.63
feet; thence S 89039' E, a distance of 110.07 feet;
thence S 78017' E, a distance of 309.85 feet; thence
S 74036 ' E , a distance of 19.22 feet; thence S 580
29' E, a distance of 33.51 feet; thence S 82*11 '
E, a distance of 179.28 feet more or less to a point
on the East line of the Northwest 1/4 of the Northwest
1/4 of said section 18; thence along said East line
S 00°57' W to the Southeast corner of the Northwest
1/4 of the Northwest 1/4 of said Section 18; thence
along the South line of the Northwest 1/4 of the
Northwest 1/4 of said Section 18 to the Northeasterly
right of way line of the Colorado and Southern Rail-
road; thence in a Northwesterly direction along said
Northeasterly right of way to a point that is N
89038' W, along the north line of said Section 13
a distance of 687.1 feet; again S 21051' W, a distance
of 308 .5 feet; and again S 40021 ' W, a distance
of 60.0 feet; and again S 49°39' E, a distance of
100.0 and again S 40°21' W, a distance of 90.1 feet

from the Northwest corner of Section 18; thence
N 40*21' E, a distance of 90.1 feet; thence N 49039'
W, a distance of 100 .0 feet; thence N 40*21' E , a
distance of 60.0 feet; thence N 21°51' E, a distance
of 120.40 feet more or less to the South right of
way line of Colorado State Highway 14; thence along
said South right of way line S 89°38' E, a distance
of 625 . 75 feet to the true point of beginning.
Excepting therefrom that parcel of land described
in Book 1954 at pages 196 and 197 as recorded in the
office of the Clerk and Recorder of said County.
be, and it hereby is, annexed to the City of Fort Collins and made a part
of said City, to be known as the Riverside-Lemay Annexation.
Section 2. That in annexing said territory to the City of Fort
Collins, the City of Fort Collins does not assume any obligation respecting
the construction of water mains, sewer lines, gas mains, electric service
lines, streets or any other services or utilities in connection with the
territory hereby annexed except as may be provided by the ordinances of the
City of Fort Collins.
Section 3. That within ninety (90) days from the date this Ordinance
becomes effective, no building permit shall be issued for any of the lands
herein described unless said lands have been zoned under the zoning ordi-
nances of the City.
Introduced, considered favorably on first reading, and ordered pub-
lished this 17th day of May A.D. 1983, and to be presented for final
passage on the 7th day of June A.D. 3.
