HomeMy WebLinkAbout099 - 08/16/1983 - ANNEXING THE EAST VINE DRIVE SEVENTH ANNEXATION 4j ,J J ORDINANCE NO. 99, 1983 OF THE COUNCIL OF THE CITY OF FORT COLLINS ANNEXING PROPERTY KNOWN AS THE EAST VINE DRIVE SEVENTH ANNEXATION TO THE CITY OF FORT COLLINS, COLORADO WHEREAS, Article II , Section .30 of the Constitution of the State of Colorado requires that one of the following conditions be met before an unincorporated area be annexed to a municipality: 1 . The question of annexation be submitted to a vote of the landowners and registered electors of the area to be annexed and the majority of such persons voting, vote in favor of annexation; or 2. The annexing municipality receive a petition for annexation signed by more than 50% of the landowners in the area who own more than 50% of the land; or 3. The area to be annexed be entirely surrounded by or be solely owned by the annexing municipality; and WHEREAS, 100% of the property owners in the East Vine Drive Seventh Annexation area have signed a petition for annexation; and WHEREAS, not less than one-sixth (1/6th) of the perimeter of the area to be annexed is contiguous with the City of Fort Collins and a community of interest exists between the territory to be annexed and the City of Fort - Collins; and the territory to be annexed is urban or will be urbanized in the near future; and such territory is integrated or is capable of being integrated with the City of Fort Collins; and WHEREAS, no election is required and no additional terms and condi- tions are to be imposed in connection with this annexation; and WHEREAS, the Council has found and determined and does hereby find and determine that said petition is in substantial compliance with the annexa- tion laws of the State Hof Colorado and that the territory is eligible for annexation, and the City Council desires to annex the same to the City of Fort Collins; and NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS: Section 1. That the following described property: A tract of land situate in the County of Larimer, State of Colorado to-wit: A tract of land situate in Section 5, Township 7 North and in Section 32, Township 8 North, Range 68 West of the Sixth P.M. , Larimer County, Colorado, which considering the North line of the Northeast 1/4 of said Section 5 as bearing S 89°57'46" E and with all bearings contained herein relative thereto is contained within the boundary lines which begin at the Northeast corner of said Section 5 and run thence along the East line of said Section 5, S 00020102" W 3612.97 feet to the North line of the Larimer and Weld Canal ; thence along the said North line, N 54017' 12" W 104.96' feet; and again N 71°38'28" W 564.83 feet; and again N 75032'41" W 347 .28 feet; and again N 81041'27" W 142.17 feet; and again N 75°13' 18" W 128.94 feet; and again N 69°46'28" W 224.20 feet; and again N 62024'45" W 117 .20 feet; and again N 54005'22" W 154.47 feet; and again N 61°41'40" W 386.54 feet; and again S 79019'24" W 86.45 feet; and again N 87033' 11" W 54.42 feet; and again S 82058'36" W 256.49 feet; and again S 76056'35" W 227.68 feet to the North-South Centerline of said Section 5; thence along said Centerline S 00000' 10" E 1904.23 feet to a point N 00000' 10" W 300 .00 feet from the South 1/4 corner of said Section 5; thence N 89010'50" W 300.00 feet; thence S 00000' 10" E 300.00 feet to the South line of the Southwest 1/4 of said Section 5 ; thence along said South line, S 89°10' 50" E 300.00 feet to the South 1/4 corner of said Section 5; thence S 00000' 10" E 80.00 feet to the South right-of-way line of the Colorado and Southern Railroad; thence along the said South line of the Colorado and Southern Railroad, N 89°10'50" W 2251.14 feet; thence N 00025' 54" E 2920 .32 feet; thence N 52037 '06" W 366 .87 feet; thence S 00°25 ' 54" W 3058.87 feet; thence N 89010'50" W 100.00 feet to the Southwest Corner of said Section 5; thence along the West line of said Section 5, N 00025'54" E 5094.58 feet to the Northwest corner of said Section 5; thence along the West line of the Southwest 1/4 of said Section 32, N 00055'50" W 400.04 feet; thence S 89"57'31" E 2607.45 feet to the North-South Centerline of said Section `32; thence along said Centerline, S 00033'14" E 400.00 feet to the North 1/4 corner of said Section 5; thence along the North line of the Northeast 1/4 of said Section 5, S 89°57'46" E 2639.51 feet to the point of beginning, containing 500.30 acres more or less, EXCEPT beginning at a point which bears S 89°10' 50" E 1473 .72 feet from the Southwest corner of said Section 5 and run thence S 89010'50" E 400.00 feet; thence N 00°49' 10" E 596.71 feet; thence N 89°10'50" W 146.00 feet; thence S 00049'10" W 82.22 feet; thence N 89°10' 50" W 254.00 feet; thence S 00049' 10" W 514.49 feet to the point of beginning. -2- S Subject to all rights-of-way, easements, and restrictions as now in use and of record. Said property contains 500.3 acres, more or less gross. be, and it hereby is, annexed to the City of Fort Collins and made a part of said City, to be known as the East Vine Drive Seventh Annexation . Section 2. That in annexing said territory to the City of Fort Collins, the City of Fort Collins does not assume any obligation respecting the construction of water mains, sewer lines, gas mains, electric service lines, streets or any other services or utilities in connection with the territory hereby annexed except as may be provided by the ordinances of the City of Fort Collins. Section 3. That within ninety (90) days from the date this Ordinance becomes effective, no building permit shall be issued for any of the lands herein described unless said lands have been zoned under the zoning ordi- nances of the City.
