OF THE COUNCIL OF THE CI776F FORT COLLINS
BEING AN ORDINANCE ANNEXING PROPERTY
KNOWN AS THE SPRINGFIELD ANNEXATION
TO THE CITY OF FORT COLLINS, COLORADO
WHEREAS, on November 4, 1980, an amendment to Article II of the
Constitution of the State of Colorado relative to annexation powers of
cities and toms was placed on the ballot, and
WHEREAS, the provisions of said amendment required that one of the
following conditions be met before an unincorporated area be annexed to a
municipality
1 The question of annexation be submitted to a vote of
the landowners and registered electors of the area to
be annexed and the majority of such persons voting,
vote in favor of annexation, or
2 The annexing municipality receive a petition for
annexation signed by more than 50% of the landowners in
the area who own more than 50% of the land, or
3 The area to be annexed be entirely surrounded by or be
solely owned by the annexing municipality, and
WHEREAS, on November 4, 1980, a majority of votes were cast in favor
of said amendment, and
WHEREAS, on December 19, 1980, the Governor of the State of Colorado
signed into law said amendment, and
WHEREAS, an annexation petition has been signed by persons comprising
more than 50% of the landowners in the Springfield Annexation area and
owning more than 50% of such area, and
WHEREAS, not less than one-sixth (1/6th) of the perimeter of the area
to be annexed is contiguous with the City of Fort Collins and a community
of interest exists between the territory to be annexed and the City of Fort
Collins, and the territory to be annexed is urban or will be urbanized in
the near future, and such territory is integrated or is capable of being
integrated with the City of Fort Collins, and
WHEREAS, no election is required and no additional terms and condi-
tions are to be imposed in connection with this annexation, and
WHEREAS, the City Council has found and determined and does hereby
find and determine that said petition is in substantial compliance with the
annexation laws of the State of Colorado and that the territory is eligible
for annexation, and the City Council desires to annex the same to the City
of Fort Collins
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS
Section 1 That all of the territory more particularly described as
situate in the County of Larimer, State of Colorado, to-itit
The North one-half of the Southwest one-quarter of
Section 35, Township 7 North, Range 69 West of the 6th
Principal Meridian, County of Larimer, State of Colo-
rado, more particularly described as follows
Beginning at the Southwest corner of the North one-half
of the Southwest one-quarter of said Section 35 said
point also being the Northwest corner of THE WOODLANDS
P U D - FILING NO 1, a plat on file and recorded in
the Office of the Larimer County Clerk and Recorder,
thence N 00'04'31" E, along the West line of the North
one-half of the Southwest one-quarter of said Section
35, a distance of 1327 26 feet to the Northwest corner
of the North one-half of the Southwest one-quarter of
said Section 35, thence N 89"47'26" E, along the North
line of the North one-half of the Southwest one-quarter
of said Section 35, a distance of 2644 32 feet to the
Northeast corner of the North one-half of the Southwest
one-quarter of said Section 35, said point also being
the Northwest corner of LARKBOROUGH SUBDIVISION, a plat
on file and recorded in the Office of the Larimer
County Clerk and Recorder, thence S 000 03'15" E, along
the East line of the North one-half of the Southwest
one-quarter of said Section 35, and along the Westerly
Boundary of said LARKBOROUGH SUBDIVISION a distance of
1325 32 feet to the Southeast corner of the North
one-half of the Southwest one-quarter of said Section
35, thence departing the Westerly Boundary of said
LARKBOROUGH SUBDIVISION, and N 89°49'57" W, along the
South line of the North one-half of the Southwest
one-quarter of said Section 35, a distance of 949 04
feet to the Northeast corner of said THE WOODLANDS
P U 0 - FILING NO 1 plat, thence continuing N 89*49'
57" W, along the South line of the North one-half of
the Southwest one-quarter of said Section 35, and along
the North line of said THE WOODLANDS P U D - FILING
NO 1 plat, a distance of 1698 27 feet to the Point of
Beginning, containing 80 56 acres more or less

be, and it hereby is, annexed to the City of Fort Collins and made a part
of said City, to be known as the Springfield Annexation
Section 2 That in annexing said territory to the City of Fort
Collins, the City of Fort Collins does not assume any obligation respecting
the construction of water mains, sewer lines, gas mains, electric service
lines, streets or any other services or utilities in connection with the
territory hereby annexed except as may be provided by the ordinances of the
City of Fort Collins
Section 3 Within ninety (90) days from the date this Ordinance
becomes effective, no building permit shall be issued for any of the lands
herein described unless said lands have been zoned under the zoning ordi-
nances of the City
Introduced, considered favorably on first reading, and ordered pub-
