HomeMy WebLinkAbout006 - 01/18/1983 - PROVIDING FOR A SPECIFIED CHARTER AMENDMENT TO BE SUBMITTED TO A VOTE OF THE QUALIFIED ELECTORS OF T rI ORDINANCE NO. 6, 1983 OF THE COUNCIL OF THE CITY OF FORT COLLINS PROVIDING FOR A SPECIFIED CHARTER AMENDMENT TO BE SUBMITTED TO A VOTE OF THE QUALIFIED ELECTORS OF THE CITY WHEREAS, Article IV, Section 8, of the Charter of the City of Fort Collins provides that the Charter may be amended as provided by the laws of the State of Colorado; and WHEREAS, 31-2-210, C.R.S. 1973, as amended, provides that Charter amendments may be initiated by the adoption of an ordinance by the Council submitting a proposed amendment to a vote of the qualified electors of the City of Fort Collins. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT . COLLINS: Section 1. That the Council has reviewed the Charter of the City of Fort Collins and desires to submit a Charter amendment to the qualified electors of the City. The following proposed Charter amendment shall be submitted to a vote of the qualified electors of the City: PROPOSED CHARTER AMENDMENT NO. 2 Amend Article II, Section 18, of the Charter of the City of Fort. Collins to read as follows: "Section 18. Vacancies. All elected officers shall hold office until their successors are elected and qualified. Any vacancy in an elected office shall be filled within ONE HUNDRED AND TWENTY days by appointment of the Council until the next regular election, when the vacancy shall be filled by the electors for the remainder of the term, if any. Any person appointed to fill a vacancy for an unexpired term in an elective office shall have the qualifica- tions required for persons to be regularly elected. In the case of a vacancy representing a member elected from a district, any person appointed or elected to fill such vacancy shall be from the same district. A vacancy shall exist when a member of the Council fails to qualify within thirty days after commencement of the term or if such member dies, resigns, removes from the City, is absent from meetings of the Council for sixty days, unless excused by resolution thereof, OR BECOMES DISQUALIFIED TO HOLD SAID OFFICE IN ACCOR- DANCE WITH THE CHARTER, or if such member is convicted of a felony or is judicially declared a mental incom- petent." s, This amendment shall be submitted in the following language: PROPOSED AMENDMENT NO. 2 An Amendment to Article II , Section 18, of the Charter providing that a vacancy on the Council shall be filled within one hundred and twenty days by appointment of the Council and, furthermore, providing that a vacancy shall exist on the Council if a member is otherwise disqualified from holding office as provided in the Charter.
