HomeMy WebLinkAbout028 - 04/05/1983 - AMENDING CERTAIN PORTIONS OF CHAPTER 69 OF THE CITY CODE RELATING TO THE LANDMARK PRESERVATION COMMI ^T ORDINANCE N0. 28, 1983 OF THE COUNCIL OF THE CITY OF FORT COLLINS AMENDING CERTAIN PORTIONS OF CHAPTER 69 OF THE CODE OF THE CITY OF FORT COLLINS RELATING TO THE LANDMARK PRESERVATION COMMISSION WHEREAS, the Landmark Preservation Commission recently recommended to the City Council that changes be made to the existing Landmark Ordinance (Chapter 69 City Code) ; and WHEREAS, upon review, City Council wishes to change certain provisions of the existing Landmark Ordinance. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS: Section 1. That §69-4(E) (Landmark Preservation Commission Meetings) be, and hereby is, amended to read as follows: §69-4(E) Meetings The Commission shall conduct business at regular monthly meetings or at any special meeting as called by the Chairman. The bylaws shall specify the time for said regular monthly meetings. Section 2. That §69-5 (Staff) of the Code of the City .of Fort Collins be, and hereby is, amended by deleting therefrom the words "Chief Building Inspector" and inserting therefor the words "Director of Planning and De- velopment. " Section 3. That §69-9(A) (Construction, Alteration, Demolition or Relocation of Structures - Review of Building Permits) of the Code of the City of Fort Collins be, and hereby is, amended by deleting therefrom subsection 2. Section 4. That §69-9(C) (Approval of Proposed Work) of the Code of the City of Fort Collins be, and hereby is, amended by deleting therefrom the words "as soon as practicable, but in no event longer than ten (10) working days after receiving the notification of the request for the permit or application. . ." Section 5. That §69-9(D) (Denial of Building Permit) of the Code of the City of Fort Collins be, and the same hereby is, amended to read as follows: §69-9(D) Denial of Building Permits If the proposed work is not approved, the Chief Building Inspector shall deny the application for the building permit and shall so advise the applicant. No reapplication shall be submitted pursuant to §69=9 under the original plans and specifications found unacceptable by the Commission except upon a showing of changed circumstances sufficient to justify the reapplication. Section 6. That §69-9(E) (Actions of Commission on Unacceptable proposed Work) of the Code of the City of Fort Collins be, and the same hereby is, amended by deleting therefrom the words " . .as outlined in subsection C above. . ." Section 7. That §69-9 (Constructions, Alterations, Demolition or Relocation of Structures) of the Code of the City of Fort Collins be, and the same hereby is, amended by the addition thereto of a new subsection "A" to read as follows, with all remaining subsections to be relettered accordingly: §69-9(A) Conceptual Review All proposals which have a significant impact on a historic district or a designated landmark shall be reviewed in two phases: Conceptual Review and a review to determine compliance with this chapter. i . Conceptual review is an opportunity for applicants to discuss requirements, standards and policies that apply to development proposals. Major problems can be identified and solved before formal application is made. ii . The general outline of the proposal , evidence schematically by sketch plans, shall be submitted by the applicant and re- viewed by the Commission. Thereafter, the Director of Com- munity Development shall furnish the applicant with written comments regarding such conference including appropriate recommendations to inform and assist the applicant prior to making a formal application.
