HomeMy WebLinkAbout022 - 03/15/1983 - AMENDING THE LEGAL DESCRIPTION AS CONTAINED IN ORDINANCE NO. 161, 1982 AND ORDINANCE NO. 162, 1982 T l � ORDINANCE N0. 22 1983 OF THE COUNCIL OF THE C=OF FORT COLLINS AMENDING THE LEGAL DESCRIPTION AS CONTAINED IN ORDINANCE NO. 161 , 1982 AND ORDINANCE NO. 162, 1982 TO EXCLUDE CERTAIN PROPERTIES FROM THE MOBILE PREMIX-PROSPECT ROAD ANNEXATION AND ZONING WHEREAS, on January 4, 1983, the Council of the City of Fort Collins, passed, on final reading, Ordinance No. 161 , 1982, annexing property known as Mobile Premix Prospect Road Annexation to the City of Fort Collins, Colorado, and, passed on final reading, Ordinance No. 162, 1982, amending Chapter 118 of the Code of the City of Fort Collins, commonly known as the Zoning Ordinance, and classifying for zoning purposes the property included in the Mobile Premix-Prospect Road Annexation to the City of Fort Collins, Colorado; and WHEREAS, as a result of a surveyor' s error, certain properties were included in said annexation and zoning, which properties were owned by persons who had not signed the petition for annexation and did not wish to be annexed into the City of Fort Collins; and WHEREAS, it is the desire of the Council of the City of Fort Collins to bring the aforesaid annexation and zoning into compliance with Colorado law and to conform the legal description of said annexation and zoning to the intent of the petitioners thereof in order that said annexation and zoning may be made entirely voluntary. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS: Section 1. That the legal description of the property to be annexed and zoned as described in S1 of Ordinance No. 161 , 1982 and in 51 of Ordi- nance No. 162, 1982, be, and hereby is, amended in its entirety as follows: A tract of land located in the East 1/2 of Section 18, and the !Jest 1/2 of Section 17 , T7N , R68W, of the 6th P. M. , Larimer County, Colorado, being more particularly described as follows: Considering the East line of said Section 18 as bearing S 00* WOO" E and with all bearings contained herein relative thereto: Commencing at the Southeast corner of said Section 18, said point being the True Point of Beginning; thence, S 89009'00" W, 100.00 feet along the South line of said East 1/2 of Section 18; thence, N 00000100" W, 759.00 feet; thence, S 88059'57" W, 133.95 feet; thence, S 89°08'06" W, 455.27 feet more or less to a point on the easterly right-of-way of the Colorado and Southern Railroad; thence, along the said easterly right-of-way on the following courses: N 18014136" W, 736.30 feet; Thence, along a spiral curve to the left with a delta of 03°00' and a chord bearing N 19015'07" W, 152.60 feet to a point of curvature; Thence, along a curve to the left with a delta of 45°38'35", an arc length of 1180.60 feet and a chord bearing N 44003'53" W, 1149.63 feet to a point of spiral curvature; Thence, along a spiral curve to the left with a delta of 03*00' and a chord bearing N 68°52'40" W, 152.60 feet; Thence, N 69053' 11" W, 779.29 feet to a point on the north-south centerline of said Section 18; thence, leaving the said easterly right-of-way of the Colorado and Southern Railroad N 00°03'02" E, 685.96 feet along the said north-south centerline of Section 18 to a point on the :Jest bank of the Cache La Poudre river; thence, along the said West bank on the following courses: S 66038110" E, 180.77 feet; Thence, N 41011'00" E, 124.14 feet; Thence, N 11°37'47" E, 152.53 feet; Thence, N 14038'53" E, 237.29 feet; Thence, N 57004'50" E, 185.17 feet; Thence, N 66018'55" E, 59.52 feet to a point on the South line of the North 1/2 of the Northeast 1/4 of Section 18; thence, leaving the said West bank of the Cache La Poudre river along the said North 1/2 line, N 89016'34" E, 84.27 feet; thence, S 68*11' 00" E, 758.68 feet; thence, S 07°27'00" E, 520.70 feet; thence, S 82-25100" E, 1249.40 feet more or less to a point on the East line of Section 18 which lies 2989.85 feet North of the Southwest corner of said Section 18; thence, S 90000'00" E, 1069.82 feet; thence , S 00000 ' 00" E, 2240.34 feet; thence, N 89029' 30" W, 1069.86 feet more or less to a point on the East line of said Section 18; thence, S 00000'00" E, 759.00 feet along the East line of said Section 18 to the True Point of Beginning. The above described tract contains 151.863 acres more or less and is subject to all easements and rights-of-way now on record or indicated on the attached plat. -2- Section 2. That the City Engineer is hereby authorized and directed to amend the Zoning District Map of the City of Fort Collins as described in §1 of Ordinance No. 162, 1982, in accordance with the legal description as contained herein.
