ORDINANCE NO. 20 , 1983
OF THE COUNCIL OF THE CM—OF FORT COLLINS
AMENDING ORDINANCE NO. 103, 1982 ,
WHICH ORDINANCE PROVIDED FOR THE CREATION
AND ORGANIZATION OF THE
BOARDWALK SPECIAL IMPROVEMENT DISTRICT #77
AND FOR THE CONSTRUCTION OF IMPROVEMENTS THEREIN
WHEREAS, on September 21 , 1982 , the Council of the City of Fort
Collins passed, on final reading, Ordinance No. 103 , 1982, providing for
the creation and organization of the Boardwalk Special Improvement District
#77 (District) , and providing for the construction of improvements therein;
and
WHEREAS, said Ordinance No. 103 , 1982, did, in Section 3 thereof,
provide that the total cost of the improvements in the District shall not
exceed more than five percent (5%) of the City Engineer' s estimate of
Five Hundred Seventy-Nine Thousand Six Hundred and Fifty-Nine Dollars
($579,659) ; and
WHEREAS, the aforesaid sum of Five Hundred Seventy-Nine Thousand Six
Hundred and Fifty-Nine Dollars ($579,659) is not sufficient to satisfy the
total cost of all improvements in said District; and the correct total
costs were properly reflected in the engineering report for the District
on file with the City Clerk in the total sum of Six Hundred Eighty-Six
Thousand and Sixty-Seven Dollars ($686,067); and
WHEREAS, it is the desire of the City Council of the City of Fort
Collins to amend Section 3 of Ordinance No. 103, 1982 , in order to conform
the total cost of the improvements to be installed in said District to that
as provided in the engineering report for the District on file with the
City Clerk; and
WHEREAS, said District is a strictly voluntary improvement district
and all parties to be assessed for the cost thereof have heretofore waived
all procedural requirements with respect to the creation of the District
including all notice requirements.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that Section 3 of Ordinance No. 103, 1982 , of the Council of the
City of Fort Collins be amended by the deletion of the numbers Five Hundred
Seventy-Nine Thousand Six Hundred and Fifty-Nine Dollars ($579 ,659 )
and by the addition of the numbers Six Hundred Eighty-Six Thousand and
Sixty-Seven Dollars ($686,067) .
Introduced, considered favorably on on first reading, and ordered pub-
lished this 15th day of February, A.D. 1983, and to be presented for final
passage on the 1st day of March, A.D. 983.
