OF THE COUNCIL OF THE CT—N OF FORT COLLINS
BEING AN ORDINANCE VACATING A UTILITY
EASEMENT BETWEEN LOTS 12 and 13 IN
LORY ANN ESTATES SUBDIVISION
WHEREAS, the city of Fort Collins intends to enlarge the area now
served by the West Prospect Booster Pump, and
WHEREAS, in order to expand the area, a water line shall be con-
structed through a newly dedicated utility easement between Lots 13 and 14
in Lory Ann Estates Subdivision, and
WHEREAS, there presently exists a utility easement located between
Lots 12 and 13 in Lory Ann Estates Subdivision, as is more particularly
described Delow, and
WHEREAS, said existing utility easement is no longer needed, and
WHEREAS, the rights of the residents of the city of Fort Collins will
in no way be prejudiced or injured by the vacation of said utility ease-
ment
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that that certain utility easement located between Lots 12 and 13
in the Lory Ann Estates Subdivision, more particularly described as fol-
lows, to-wit
Considering the West line of the SW 1/4 of Section 16,
Township 7 North, Range 69 West of the Sixth P M , Fort
Collins, Colorado, as bearing S 00°00'00" E, and with
all bearings contained herein relative thereto
Commencing at the W 1/4 corner of said Section 16, said
1/4 corner being the NW corner of Lory Ann Estates, a
subdivision on file with the Larimer County Clerk and
Recorder, thence, S 00 00'00" E, 470 48 feet along the
West line of the SW 1/4 of said Section 16, said line
also being the Westerly boundary of the said Lory Ann
Estates, thence, S 79°52'00" E, 50 79 feet, thence N
00°00'00" W, 91 00 feet along the East right-of-way of
Overland Trail , thence, N 77 00'40" E, 6 16 feet to
the center line and beginning point of the 10 foot wide
utility and access easement to be vacated, thence,
along the center line of said easement, N 77°00'40"
E, 143 09 feet to the terminus point of said easement
be, and ,t hereby is, vacated, abated and abolished
Introduced, considered favorably on first reading, and ordered pub-
lished this 21st day of April , A D 1981 , and to be presented for final
pasasage on the 5th day of May, A D 1981
