REPEALING SECTION 112-84 OF THE CODE OF
THE CITY OF FORT COLhINS AS IT RELATES
TO INDUSTRIAL COST RECOVERY CHARGES A" D
AUTHORIZING THE RETURd, AFTER COMPUTATION AND
APPROPRIATION, OF ALL FUNDS COLLECTED
PURSUANT TO SAID SECTION FROM AND AFTER
DECEMBER 27, 197/
WHEREAS, in 1976, the City established an industrial cost recovery
system as a requirement Of dccepting a grant from the Environmental Protec-
tion Agency, and
WHEREAS, subsequent to the establishment of said industrial cost
recovery system, Congress did repeal the requirrrrient of such system retro-
active to Decembcz 27, 1977, and
WHEREAS, it is determined to be in the best interests of the citizens
of the City of Fort Collins that the Industrial Cost Pecovery System as
established in Section 112-84 of the Code of the City of Fort Collins be
repealed and that the funds collected pursuant thereto from and after
December 27, 19/7, be returned to the appropriate contributors after
computation and appropriation therEfor
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows
(1) That Section 112-84 of the Code of the City of Fort Collins be
arid hereby is repealed
(2) That all funds collected from and after December 27, 1977,
pursuant to said Section 112-84 of the Code of the City of Fort
Collins be returned, after computation and appropriation, to the
appropriate contributing industries
Introduced, considered favorably on first reading, and ordered pub-
lished this 19th day of May, A D 1981, and to be presented for final
passage on the 2nd day of June, A D 1981
