CREATION AND ORGANIZATION OF THE SOUTH MASON STREET AND UTILITY IMPROVEMENT DISTRICT NO 75 AND PROVIDING FOR THE CONSTRUCTION OF IMPROVEMENTS THEREIN WHEREAS, heretofore, the necessary proceedings were instituted to create the South Mason Street and Utility Improvement District No 75 for the purpose of installing street and utility improvements on specified portions of South Mason Street for the benefit of property adjacent thereto, and WHEREAS, the City Council is of the opinion that it is in the best interests of the City of Fort Collins to form said South Mason Street and Utility Improvement District No 75 NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS Section 1 That there is hereby created and organized an improvement district under and by virtue of the provisions of Chapter 16 of the Code of the City of Fort Collins to be known as the "South Mason Street and Utility Improvement District No 75" (hereinafter sometimes referred to as "the District"), comprised of the property described on Exhibit "A", attached hereto Section 2 That the improvements to be constructed shall consist of the improvements as set forth in the map, plans and specifications hereto- fore submitted by the Director of Public Works and accepted by the City Council by resolution Section 3 That the total cost of such improvements shall not exceed by more than five percent the estimate heretofore accepted of total construction costs of Three Hundred Forty Nine Thousand Six Hundered and Two Dollars exclusive of the expense of collection, legal ,advertising, engineering, financing, interest during construction and other incidentals, and that said total costs, together with such expense of collection, legal , advertising, engineering, financing, interest during construction and other incidentals ( in the estimated amount of Eighty Thousand Four Hundred and Nine Dollars, and not to exceed Twenty-Seven percent of the actual con- struction or acquisition cost, and excepting interest during construction not to exceed 15%) shall be assessed against the property in said district in accordance with the provisions of Chapter 16 of the Code of the City of Fort Collins Section 4 That the requirement for publication and hearing having been waived by all property oemers rithin said district, the Council of the City of Fort Collins finds that all requirements of the ordinances of the City of Fort Collins respecting the organization of the district have been observed and complied with in all respects, and it is hereby ordered that the improvements in the district as provided for in the map, plans and specifications heretofore adopted by the City Council be, and they hereby are, ordered to be constructed Section 5 Upon the effective date of this ordinance, the Mayor is hereby authorized and enpowcred to advertise for bids for the construction of the improvements in accordance iith the map, plans and specifications heretofore adopted, which advertisement shall be trice published in an official newspaper published in the City Said publications are to be at least a veek apart, and the date for opening of bids shall not be less than ten (10) days after first publication, and bids received under said adver- tisPment shall be submitted to the Council for appro%al or rejection Advertisement for bids shall comply with the requirements and be in accor- dance with the provisions of Chapter 16 of the Code of the City of Fort Collins Section 6 When the improvements herein authorized have been com- pleted and the saine approved and accepted by the City of Fort Collins, the costs as set forth above shall be assessrd upon the real property in said improvement district, all as herc,inoefore set forth Section 7 This ordinance shall be irrepealable until the indebted- ness herein provided for, whenever the same shall be created, shall have been duly paid, satisfied and discharged as herein provided Introduced,
