OF THE COUNCIL OF THE CITY OF FORT COLLINS
BEING AN ORDINANCE VACATING A RAILROAD ACCESS
EASEMENT LOCATLD IN PROSPECT INDUSTRIAL PARK
WHEREAS, the City Council has been petitioned to vacate a railroad
access easement located in Prospect Industrial Park, as is more particu-
larly described below, and
WHEREAS, said access easement is not presently needed, and
WHEREAS, the rights of the residents of the City of Fort Collins will
in no way be prejudiced or injured by the vacation of said access easement
provided that an access easement, as shown on the revised plat of Lots 33
and 34, Prospect Industrial Park, be dedicated to the City
NOW, THEREFORE, BE IT RESOLVLD BY THE COUNCIL OF THE CITY OF FORT
COLLINS that that certain access and loading easement located between Lots
33 and 34, Tract A, Prospect Industrial Park be, and it hereby is, abol-
ished , vacated and abated provided that owners of Lots 33 and 34 of
Prospect Industrial Park dedicate to the City an access easement as shown
on the revised plat of Lots 33 and 34, Prospect Industrial Park
Introduced, considered favorably on first reading and ordered pub-
lished this 18th day of August 1981, and to be presented for final
passage on the 1st day of September 1981
