HomeMy WebLinkAbout058 - 06/02/2009 - AUTHORIZING THE LEASE OF THE COLLINDALE GOLF COURSE RESIDENCE LOCATED AT 1341 EAST HORSETOOTH ROAD F ORDINANCE NO. 058, 2009 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE LEASE OF THE COLLINDALE GOLF COURSE RESIDENCE LOCATED AT 1341 EAST HORSETOOTH ROAD FOR UP TO FIVE YEARS WHEREAS, the City is the owner of the property at 1341 East Horsetooth Road, Fort Collins, Larimer County, Colorado, also known as the Collindale Golf Course Residence, as depicted on Exhibit "A", attached and incorporated herein by reference (the "Residence"); and WHEREAS, the Residence was built in 1970 and was occupied by the golf course superintendents until 1997, and has since been rented by the Golf Division to various individuals; and WHEREAS, the City wishes to lease the Residence for a term of one year, with the City having the option to renew the lease for additional one-year terms up to a total of five years, at an annual rate of at least $13,200.00; and WHEREAS, the lease of the Residence would be beneficial in that it would discourage vandalism and reduce the City's costs to maintain the Residence; and WHEREAS, under Section 23-111 of the City Code, the City Council is authorized to sell, convey or otherwise dispose of any and all interests in real property owned by the City provided that the City Council first finds, by ordinance, that such sale or other disposition is in the best interests of the City. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the City Council hereby finds that leasing the Residence at 1341 East Horsetooth Road as provided herein is in the best interests of the City. Section 2. That the City Manager is hereby authorized to execute a Lease Agreement for the Residence, consistent with the terms of this Ordinance, together with such additional terms and conditions as the City Manager, in consultation with the City Attorney, deems necessary and appropriate to protect the interests of the City or to effectuate the purposes of this Ordinance, including, but not limited to, any necessary changes to the description of the Residence, so long as such changes do not materially increase the size or change the character of the property to be leased. Introduced, considered favorably on first reading, and ordered published this 19th day of May, A.D. 2009, and to be presented for final passage on the 2pdda of June, A.D. 2009.
