HomeMy WebLinkAbout163 - 11/03/1981 - AMENDING SECTION 99-6 OF THE CITY CODE TO PROVIDE FOR ACCESS TO ARTERIAL STREETS AND FOR THE COLLECT ORDINANCE NO 163 , 1981 OF THE COUNCIL OF THE CITY OF FORT COLLINS AMENDING SECTION 99-6 OF THE CODE OF THE CITY TO PROVIDE FOR ACCFSS TO ARTERIAL STREETS AND FOR THE COLLECTION OF FUNDS AND REIMBURSEMENT TO DEVELOPERS WHO CONSTRUCT STREETS WHICH BENEFIT ADJACENT PROPERTY OWNERS WHEREAS, in the interest of providing for the safety and welfare of the citizens of the City of Fort Collins, the Council of the City of Fort Collins has determined that certain public improvements to arterial streets were necessitated by the development of subdivisions and planned unit developments which would not have direct access to adequate arterial streets, and WHEREAS, increased vehicular and pedestrian traffic that may be generated by such subdivisions and planned unit developments directly threaten the public safety of the users of the streets serving such devel- opments, and WHEREAS, the Council of the City of Fort Collins desires to encourage development to locate in areas where the City has already made investments in the street system, or is planning to do so within the next five years, and WHEREAS, the Council of the City of Fort Collins desires to assure that any development that does not occur in the areas where adequate arterial streets have been constructed or planned would be responsible for providing street improvements necessary, in the interest of the public safety and welfare, to accommodate the increased traffic generated by such development, and WHEREAS, the Council of the City of Fort Collins has previously enacted ordinances which provide for the collection of funds and reimburse- ment to persons who construct sewer and water lines which benefit other adjacent property owners, and WHEREAS, it has been determined by the Council of the City of Fort Collins that similar provisions should be included in the Code of Ordi- nances of the City providing for the collection of funds and reimbursement to persons who construct streets, alleys and paths within the City of Fort Collins which benefit adjacent property owners NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that Section 99-6 B(6) be amended to provide as follows (6) Streets and Alleys All subdivisions and Planned Unit Developments must have access to an improved arterial street or to an arterial street designated for improve- ment in the City' s five-year plan for arterial streets Any subdivision or Planned Unit Development whicn does r J not have direct access to an improved arterial street or an arterial street designated for improvement in the five-year plan would be required to improve streets off-site with adequate capacity to accommodate the projected traffic from the development Off-site improvements would be required to include, at a mini- mum, thirty-six (36) feet of pavement on an adequate base for the ultimate design of the street as desig- nated on the Master Street Plan Streets and alleys shall be graded, base construction completed and all payments fully made for existing beneficial streets pursuant to the reimbursement to original installer provisions as contained herein When any person constructs a street, alley or path through undeveloped areas to serve his property or constructs such improve- ments along the perimeter of his property, the entire cost of such improvements shall be paid by such person If he has furnished the City a recapitulation of the construction costs and has entered into an agreement with the City within ninety days of the completion of such improvements, then , at the time the property abutting such improvements is developed and access to such improvements is accomplished , the City may collect a charge per front foot, and if so collected, shall reimburse the original installer to the extent of such collection after making any necessary adjustments The amount of the reimbursement may be the original cost of the improvements, plus any mutually agreed upon amount to reflect the effects of inflation, if any Any right to reimbursement pursuant to this provision shall not exceed a period of ten years from the execu- tion of the agreement The City Council may approve extensions of the agreement for additional ten-year periods Introduced, considered favorably on first reading, and ordered pub- lished this 20th day of October, A D 1981, and to be presented for final passage on the 3rd day of November, A ZV Mayor ATTEST " �k0 City Clerk �— Passed and adopted on final reading this 3rd day of November, A D 1981 0-7 PIA- ATTESTIV hla1f/ City Clerk -2-
