OF THE COUNCIL OF THE CITY OF FORT COLLINS
VACATING A PORTION OF RIGHT-OF-WAY AS DEDICATED ON
THE PLAT OF RIGDEN FARM, FILING ONE
WHEREAS, on the plat of Rigden Farm, Filing One, certain rights-of-way are dedicated
to the public, including rights-of-way for future street extensions; and
WHEREAS, the City's Administrative Hearing Officer has approved a project
development plan for a project entitled "Rigden Farm, Twelfth Filing Brooklyn Park Row
Houses" (the `Brooklyn Park Row Houses PDP"), which plats certain property abutting said
rights-of-way; and
WHEREAS, the approval of the Brooklyn Park Row Houses PDP necessitates the
vacation of a portion of the original right-of-way dedicated on the plat of Rigden Farm, Filing
One, since that portion of right-of-way was intended to accommodate a future street extension
that is no longer needed under the Brooklyn Park Row Houses PDP; and
WHEREAS, pertinent City agencies and private utility companies have been contacted
and reported no objection to the proposed vacation, provided that utility easement be reserved
unto the City; and
WHEREAS, the right of the residents of the City of Fort Collins will not be prejudiced or
injured by the vacation of said street right-of-way.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
FORT COLLINS that the portion of street right-of-way, more particularly described on Exhibit
"A", attached hereto and incorporated herein by this reference, is hereby vacated, abated and
abolished.
Introduced, considered favorably on first reading, and ordered published this 15th day of
May, A.D. 2007, and to be presented for final passage on the 5 y of June, A . 2007

located in the Northwest Quarter(NW 1/4)of Section Twenty-nine(29),Township Seven North(173N.),
Range Sixtyeight West(R.68W.)of the Sixth Principal Meridian(6th P.M.),City of Fort Collins,County of
Larimer,State of Colorado and being more particularly described as follows:
COMMENCING at the intersection of Custer Drive and Kansas Drive and assuming the centerline of
Kansas Drive as bearing North 00009'08"West being a Grid Bearing of the Colorado State Plane
Coordinate System,North Zone,North American Datum 1993/92,a distance of 111.58 feet with all other
