HomeMy WebLinkAbout092 - 07/18/2006 - APPROPRIATING PRIOR YEAR RESERVES DESIGNATED FOR FIRE SERVICES IN THE CAPITAL IMPROVEMENT EXPANSION ORDINANCE NO. 092, 2006 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING PRIOR YEAR RESERVES DESIGNATED FOR FIRE SERVICES IN THE CAPITAL IMPROVEMENT EXPANSION FUND FOR PAYMENT TO THE POUDRE FIRE AUTHORITY TO BE USED FOR HEADQUARTERS BUILDING EXPANSION WHEREAS, the City of Fort Collins has recognized and addressed the issue of requiring future growth and new development to contribute its proportionate share of the cost ofproviding new capital facilities and infrastructure required to maintain the City's level of services to its residents; and WHEREAS,the City Council adopted Ordinance No.051, 1996,on May21, 1996,amending the City Code by adding a new article pertaining to the imposition of capital expansion fees to be used to fund capital improvements for the library, community parks, police services, fire services, and general government facilities; and WHEREAS,the capital expansion fees imposed under the provisions of the aforementioned article of the City Code,including a Fire Protection Capital Improvement Expansion Fee,went into effect on July 1, 1996, and the City has since been receiving such fees as a condition of the issuance of building permits in the City; and WHEREAS,the administrative headquarters of the Poudre Fire Authority(the"Authority"), located at 102 Remington Street,house the Fire Prevention Bureau as well as operations and those administrative personnel of the Authority whose duties include the management and coordination of public education and emergency services; and WHEREAS,expansion of the administrative headquarters(the"Project")has been a priority of the Authority for several years due to shortages of space in meeting both current and future needs at the facility; and WHEREAS, City Code Section 7.5-30(a)requires that capital improvement expansion fees for fire services be used only for capital improvements related to the provision of fire services, as such improvements may be identified in the capital improvements plan for fire protection services; and WHEREAS the Project is included in the Poudre Fire Authority 2004 Strategic Plan adopted > J ,Y g P by the Board of Directors of the Authority on March 22, 2005; and WHEREAS,the estimated cost of the Project is$2,165,000,with funding sources identified as follows: City of Fort Collins Fire Protection Capital Improvement Expansion Fees $ 1,400,176 Poudre Fire Authority Existing Appropriations 764,824 Total $ 2,165,000 WHEREAS,the aforementioned request for appropriation of said fees is consistent with the uses of the fees set forth in Chapter 7.5 of the City Code; and WHEREAS,funds are available in the Fire Protection Capital Improvement Expansion Fund from prior year reserves in the amount of$1,400,176; and WHEREAS,Article V, Section 9,of the Charter of the City of Fort Collins permits the City Council to appropriate by ordinance at any time during the fiscal year such funds for expenditure as may be available from reserves accumulated in prior ears notwithstanding that such reserves were Y P Y g not previously appropriated; and WHEREAS, it is the desire of the Council to appropriate the sum of$1,400,176 from prior year reserves designated for fire services in the Fire Protection Capital Improvement Expansion Fund for payment to the Poudre Fire Authority to be used for the expansion of the Authority's administrative headquarters located at 102 Remington Street. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that there is hereby appropriated from prior year reserves designated for fire services in the Fire Protection Capital Improvement Expansion Fund, the sum of ONE MILLION FOUR HUNDRED THOUSAND ONE HUNDRED SEVENTY-SIX DOLLARS($1,400,176),for payment to the Poudre Fire Authority to be used for the expansion of the Authority's administrative headquarters located at 102 Remington Street. Introduced,considered favorably on first reading,and ordered published this 6th day ofJune, A.D. 2006, and to be presented for final passage on the 18th day of July, A.D. 2006.
