OF THE COUNCIL OF THE CITY OF FORT COLLINS
VACATING A PORTION OF THE RIGHT-OF-WAY OF
MCMURRAY AVENUE IN THE REPLAT OF TRACT "A",
GOLDEN MEADOWS, FIFTH FILING
WHEREAS, the Council of the City of Fort Collins has been petitioned
by the owner of the Replat of Tract "A", Golden Meadows, Fifth Filing to
vacate a portion of the right of way of McMurray Avenue located adjacent to
Lots 48 and 52 of the Replat of Tract "A", Golden Meadows, Fifth Filing,
more particularly described below; and
WHEREAS, City agencies and private utilities have been contacted and
report no objection to the proposed vacation; and
WHEREAS, there will be no cost to the City in making the proposed
vacation; and
WHEREAS, the rights of the residents of the City of Fort Collins will
not be prejudiced or injured by said vacation.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the right-of-way of McMurray Avenue located adjacent to Lots
48 and 52 of the Replat of Tract "A", Golden Meadows, Fifth Filing, more
particularly described as follows, to wit:
A part of McMurray Avenue adjacent to Lots 48 and 52 of the
Replat of Tract "A", Golden Meadows, Fifth Filing, City of Fort
Collins, County of Larimer, State of Colorado, which begins at
the most easterly corner of said Lot 52 and runs thence S
58021'51" E 19.98 feet; thence S 32°40'20" W 65.22 feet; thence
along the arc of a 103.60 foot radius curve to the left a
distance of 59.08 feet, the long chord of which bears S 16°20'10"
W 58.28 feet; thence along the arc of a 230.00 foot radius curve
to the right a distance of 127.78 feet, the long chord of which
bears N 15'54'57" E 126.14 feet to the point of beginning,
containing 1,259 square feet, more or less, and being subject to
an easement for drainage and utilities;
be, and the same hereby is, vacated, abated and abolished; provided,
however, that said right-of-way as above described shall be retained for
drainage and utility purposes.
Introduced, considered favorably on first reading, and ordered
published this 18th day of July, A.D. 1989, and to be presented for final
passage on the 1st day of August, A.D. 1989.
