OF THE COUNCIL OF THE CITY OF FORT COLLINS
AMENDING SECTIONS 22-134 AND 25-29(4) OF THE CODE
REFERENCING ELIGIBILITY REQUIREMENTS SET FORTH IN
COLORADO STATE STATUTES
WHEREAS, the City of Fort Collins has established a deferred payment
program for special assessments and an ad valorem tax refund program for
the elderly and disabled; and
WHEREAS, the qualifications for these programs are based on the
qualifications for the State of Colorado "Property Tax - Rent - Heat or
Fuel Assistance for the Elderly or Disabled;" and
WHEREAS, the statutes establishing the guidelines for the State's
program have changed; and
WHEREAS, it is necessary to amend the Code of the City of Fort Collins
to correctly reference the pertinent statutes.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That Section 22-134 of the Code of the City of Fort
Collins is hereby amended to read as follows:
Sec. 22-134. Eligibility for deferment.
In order to be entitled to a deferment of assessments under this
Article, an applicant at the time of application must comply with
the income limitations as provided by the state for real property
tax assistance and heat or fuel expenses assistance as
particularly set forth in Sections 39-31-101(3) and 39-31-104(3),
C.R.S.
Section 2. That Section 25-29(4) of the Code of the City of Fort
Collins is hereby amended to read as follows:
Sec. 25-29. Qualifications.
(4) The applicant must comply with the income limitations as
provided by the state for real property tax assistance and heat
or fuel expenses assistance as set forth in Sections 39-31-101(3)
and 39-31-104(3), C.R.S.
Introduced, considered favorably on first reading, and ordered
published this 18th day of July, A.D. 1989, and to be presented for final
passage on the 1st day of August, A.D. 1989.
