HomeMy WebLinkAbout130 - 10/17/1989 - AMENDING THE CITY CODE RELATING TO DEFINITIONS AND PLATTING REQUIREMENTS ORDINANCE NO. 130, 1989 OF THE COUNCIL OF THE CITY OF FORT COLLINS AMENDING CHAPTER 29 OF THE CODE OF THE CITY OF FORT COLLINS RELATING TO DEFINITIONS AND PLATTING REQUIREMENTS WHEREAS, as a part of the recodification process of the City Code completed in 1987, the consolidation of the subdivision and zoning chapters of the Code into one chapter has resulted in the creation in Chapter 29 of multiple definitions of the same terms; and WHEREAS, in order to avoid conflicts and to clarify the meaning and intent of Chapter 29 of the Code, it is desirable to consolidate all definitions into Section 29-1 and, accordingly, repeal Sections 29-621 and 29-622; and WHEREAS, as a result of the application of the definitions of Section 29-1 of the Code to the subdivision ordinances of the City, Section 29-625 needs to be amended to better describe the intention of the Code as it was originally drafted prior to recodification and to provide greater predictability and precision in administering Section 29-625 with respect to platting requirements triggered by construction. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1 . That the definition of street, as contained in Section 29-1 of the Code of the City of Fort Collins, is hereby amended to read as follows: Street shall mean a way for motorized vehicular traffic whether designated as a street, highway, thoroughfare, parkway, throughway, road, avenue, boulevard, lane, place or however otherwise designated. Section 2. That Section 29-1 of the Code of the City of Fort Collins is hereby amended by adding the following definitions in alphabetical order, to read as follows: A11ey shall mean a minor way used primarily for vehicular service access to the back of properties abutting on a street. Arterial street shall mean a street or highway which is used primarily for fast or heavy traffic. Collector street shall mean a street or road which carries traffic from local streets to the system of major arterial streets or highways and is designed to move traffic to parks, schools and shopping centers serving residential neighborhoods. Local street shall mean a street which is used primarily for access to the abutting properties. Marginal access street shall mean a local street which is parallel to and adjacent to expressways or major arterials and which provides access to abutting properties and protection from through traffic. Place shall mean a minor way used primarily for vehicular access to the abutting properties, provided that no place shall have a greater length than three hundred fifty (350) feet, and provided further that no place shall provide access to more than fifteen (15) lots, and provided further that no discontinuous place (cul -de-sac) shall provide access to more than fifteen (15) dwelling units. Subdivider or developer shall mean any person, partnership, joint venture, association or corporation who shall participate as owner, promoter, developer or sales agent in the planning, platting , development , promotion , sale and lease of a subdivision. Subdivision shall mean the platting of a lot or the division of a lot, tract or parcel of land into two (2) or more lots, plots or sites. Section 3. That Sections 29-621 and 29-622 of the Code of the City of Fort Collins are hereby repealed in their entirety. Section 4. That Section 29-625(b) of the Code of the City of Fort Collins is hereby repealed and reenacted, to read as follows: (b) Except with respect to property which is platted as an official subdivision or planned unit development (or part thereof) approved in accordance with the provisions of this Chapter, no building permit or certificate of occupancy shall be issued for any of the following and no person shall perform any of the following: (1) Construction of any new principal building. (2) Enlargement of any principal building used for nonresidential purposes by more than twenty-five (25) percent of the existing floor area of such building. (3) An act which changes the use of any building.
