HomeMy WebLinkAbout008 - 02/01/2000 - APPROPRIATING UNANTICIPATED REVENUE IN THE TRANSPORTATION SERVICES FUND TO BE USED FOR THE DESIGN AN ORDINANCE NO. 8, 2000 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING UNANTICIPATED REVENUE IN THE TRANSPORTATION SERVICES FUND AND AUTHORIZING THE TRANSFER OF APPROPRIATIONS TO BE USED FOR THE DESIGN AND CONSTRUCTION OF THE TIMBERLINE ROAD BIKEWAY PROJECT WHEREAS, Timberline Road south of Harmony Road to Trilby Road was identified in the City of Fort Collins Bicycle Program Plan (1995) as a high priority in terms of needed improvements; and WHEREAS, on April 20, 1999, the City Council adopted Ordinance No. 44, 1999, appropriating a total of one million one hundred nineteen thousand seven hundred eighteen dollars ($1,119,718),in the form of Street Oversizing Fees,developer contributions,and a contribution from the Fort Collins/Loveland Water District to be used for reconstruction of the roadway, curb, gutter, sidewalks, bikelanes, and installation of a new water main along the section of Timberline Road from Harmony Road, south to Willow Springs; and WHEREAS,bikelanes on Timberline Road were constructed as part of the aforementioned project from Harmony Road south to Willow Springs; and WHEREAS,the Colorado Department of Transportation(CDOT)has made available to the City of Fort Collins,Transportation Equity Act for the 21 st Century ("TEA-21 Funds")funds in the amount of two hundred sixty thousand dollars ($260,000) to be used for preliminary design plans, final engineering documents, and construction of bikelanes along Timberline Road from Willow Springs Way, south to Trilby Road(the "Project'); and WHEREAS, the estimated cost of the Project is three hundred twenty-six thousand three hundred eighty-three dollars ($326,383); and WHEREAS, local matching funds needed for the Project, totaling sixty-six thousand three hundred eighty-three dollars ($66,383), have been identified from existing appropriations in the Transportation Services Fund; and WHEREAS,the City Council adopted Resolution 2000-10,on January 18,2000,authorizing the City to enter into an intergovernmental agreement with CDOT for the receipt of TEA-21 Funds to be used for the design and construction of bikelanes along Timberline Road from Willow Springs Way, south to Trilby Road; and WHEREAS, Article V, Section 9, of the Charter of the City of Fort Collins(the "Charter") permits the City Council to make supplemental appropriations by ordinance at any time during the fiscal year,provided that the total amount of such supplemental appropriations,in combination with all previous appropriations for that fiscal year,do not exceed the then current estimate of actual and anticipated revenues to be received during the fiscal year; and WHEREAS,Article V, Section 10,of the Charter authorizes the City Council to transfer by ordinance any unexpended and unencumbered amount or portion thereof from one fund or capital project to another fund or capital project,provided that the purpose for which the transferred funds are to be expended remains unchanged; and WHEREAS, it is the desire of the Council to appropriate the sum of two hundred sixty thousand dollars($260,000)in Colorado Department of Transportation TEA-21 funds and authorize the transfer of sixty-three thousand three hundred eighty-three dollars ($66,383) in local matching funds in the Transportation Services Fund to be used for the design and construction of bikelanes along Timberline Road from Willow Springs Way, south to Trilby Road. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That there is hereby appropriated for expenditure from unanticipated revenue in the Transportation Services Fund, Timberline Road from Willow Springs Way, south to Trilby Road project, the sum of TWO HUNDRED SIXTY THOUSAND DOLLARS ($260,000) from Colorado Department of Transportation TEA-21 funds, to be used for the design and construction of bikelanes along Timberline Road from Willow Springs Way, south to Trilby Road. Section 2. That the unexpended appropriated amount of SIXTY-SIX THOUSAND THREE HUNDRED EIGHTY-THREE DOLLARS($66,383)is hereby authorized for transfer from operations dollars in the Transportation Planning 2000 budget in the Transportation Services Fund to the Timberline Road from Willow Springs Way, south to Trilby Road project and appropriated therein to be used for the design and construction of bikelanes along Timberline Road from Willow Springs Way, south to Trilby Road. Introduced and considered favorably on first reading and ordered published this 18th day of January, A.D. 2000, and to be presented for final passage on the 1 st day of February, A.D. 2000.
