HomeMy WebLinkAbout132 - 08/17/1999 - APPROPRIATING UNANTICIPATED REVENUE FOR INSTALLING NEW CROSSING WARNING DEVICES AT LARIMER COUNTY RO ORDINANCE NO. 132, 1999 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING UNANTICIPATED REVENUE IN THE CAPITAL PROJECTS FUND MINOR STREETS CAPITAL PROJECT TO BE USED TO INSTALL NEW CROSSING WARNING DEVICES AT THE LARIMER COUNTY ROAD 32 AND UNION PACIFIC RAILROAD CROSSING WHEREAS, Article V, Section 9, of the Charter of the City of Fort Collins (the "Charter") permits the City Council to make supplemental appropriations by ordinance at any time during the fiscal year,provided that the total amount of such supplemental appropriations,in combination with all previous appropriations for that fiscal year, does not exceed the then current estimate of actual and anticipated revenues to be received during the fiscal year; and WHEREAS,the City Council adopted Resolution 99-96,on August 3, 1999,authorizing the City to enter into a contract with the Colorado Department of Transportation(CDOT)and the Union Pacific Railroad Company for the receipt of Intermodal Surface Transportation Efficiency Act funds (ISTEA) to be used to install new crossing warning devices at the Larimer County Road 32 and Union Pacific Railroad crossing (the "Project"); and WHEREAS, the estimated cost of the Project is One Twenty-Nine Thousand Dollars ($129,000); and WHEREAS, CDOT has made available to the City, Intermodal Surface Transportation Efficiency Act funds to pay for one hundred(100) percent of the cost($126,758) of installing new crossing warning devices at the Project; and WHEREAS,local funds,totaling Two Thousand Two Hundred Forty-Two Dollars($2,242) have been identified and are appropriated in the 1999 Capital Projects Fund Minor Streets Capital project to be used to reimburse the Colorado Department of Transportation for its costs in administering the Project; and WHEREAS, it is the desire of the Council to appropriate the sum of$126,758 in federal Intermodal Surface Transportation Efficiency Act funds to be used to install new crossing warning devices at the Larimer County Road 32 and Union Pacific Railroad crossing. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that there is hereby appropriated for expenditure from unanticipated revenue in the Capital Projects Fund Minor Streets Capital project,the sum of ONE HUNDRED TWENTY-SIX THOUSAND SEVEN HUNDRED FIFTY-EIGHT DOLLARS ($126,758), upon receipt from Colorado Department of Transportation Intermodal Surface Transportation Efficiency Act funds,to be used to install new crossing warning devices at the Larimer County Road 32 and Union Pacific Railroad crossing. Introduced and considered favorably on first reading and ordered published this 3rd day of August, A.D. 1999, and to be presented for final passage on the 17th day of August, A.D. 1999.
