OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE CITY TO GRANT A NON-EXCLUSIVE
EASEMENT FOR UNDERGROUND CABLE
TO U.S. WEST AND POUDRE VALLEY RURAL ELECTRIC ASSOCIATION, INC.
WHEREAS, the City of Fort Collins is the owner of the land known as Tract "D" of
Coventry Subdivision,Filing No. 1, which is served by existing U.S. West and Poudre Valley Rural
Electric Association, Inc. ("REA") lines; and
WHEREAS, the widening of Harmony Road will require that U. S. West and REA to
relocate their underground cable; and
WHEREAS, in order to relocate the subject lines, U.S.West and REA need a non-exclusive
easement to construct, operate, maintain, repair and replace underground cable; and
WHEREAS, Section 23-111 of the City Code authorizes the City Council to sell interests in
real property owned in the name of the City, provided that the Council first finds, by ordinance, that
such sale or other disposition is in the best interests of the City.
NOW,THEREFORE,BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That the above-described sale and conveyance of an easement interest is in
the best interest of the City of Fort Collins.
Section 2. That the City Manager is hereby authorized to execute an Easement
Dedication conveying a non-exclusive easement for underground cable to U.S. West and REA,
through, under and across the following described property:
The North 15.00 feet of Tract D of Coventry Subdivision,Filing No. 1 to the City of
Fort Collins, Larimer County, Colorado Containing 9,221.00 square feet more or
less.
Introduced, considered favorable on first reading, and ordered published this 3rd day of
September, A.D. 1996, and to be presented for final passage on the 7th day of Septemb D.
1996.
