HomeMy WebLinkAbout082 - 08/03/1993 - AMENDING CITY CODE RELATING TO PARKLAND FEES ORDINANCE NO. 82, 1993 OF THE COUNCIL OF THE CITY OF FORT COLLINS, AMENDING SECTION 23-227 OF THE CODE OF THE CITY OF FORT COLLINS RELATING TO PARKLAND FEES, INCREASING THE AMOUNT OF SAID FEE TO $779 AND PROVIDING FOR THE ANNUAL ADJUSTMENT OF THE FEE ACCORDING TO THE DENVER-BOULDER CONSUMER PRICE INDEX WHEREAS, the City has imposed a Parkland Fee on new dwelling units for the acquisition and development of parks; and WHEREAS, from time to time, it is necessary to increase the Parkland Fee so as to provide sufficient funds to acquire and develop new neighborhood parks; and WHEREAS, rising costs and decreasing residential densities in areas in need of parks have reduced the revenues available to fund the acquisition and development of said parks; and WHEREAS, an increase in the Parkland Fee from $625 to $926 will provide sufficient revenues to acquire and develop needed neighborhood parks, while still fairly apportioning the costs of said parks among the new dwelling units generating the need for the same; and WHEREAS, additional study is needed to determine whether changes should be made to the policies underlying the Parkland Fee. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS AS FOLLOWS: Section 1. That Section 23-227 of the Code of the City of Fort Collins is hereby amended to read as follows: Sec. 23-227. Collection of fee for utility services. Hereafter, no original permanent connection for utility service shall be permitted by the city for any dwelling unit outside or inside the limits of the city until a fee of Seven Hundred Seventy- Nine Dollars ($779.) per dwelling unit connected is paid to the Financial Officer. All such payments shall be deposited by the Financial Officer in the fund created in §8-80. Only one (1) fee of Seven Hundred Seventy-Nine Dollars ($779. ) shall be charged for any dwelling unit. No additional fee for acquisition and development of parklands shall be charged for additional utility connections to the same dwelling unit. If any structure already connected to a city utility is remodeled so that the number of dwelling units within such structure is increased, an additional fee of Seven Hundred Seventy-Nine Dollars ($779.) for each additional unit added in the structure shall be payable by the property owner and collected before the building permit for such remodeling is issued. Section 2. That the increase in Parkland Fees set forth above shall become effective on August 13, 1993. Section 3. That the City Manager is hereby directed to review possible changes in the Parkland Fee structure and the City policies for funding the acquisition and development of new neighborhood parks and to present alternative proposals regarding this subject to Council for its consideration on or before December 7, 1993. Section 4. That, absent any such change in policy, the City Manager is further directed to annually review the amount of the Parkland Fee in relation to the Denver-Boulder Consumer Price Index and to submit for Council 's consideration any future increases to the amount of said fee which may be warranted by such review.
