OF THE COUNCIL OF THE CITY OF FORT COLLINS
SUBMITTING A PROPOSED AMENDMENT TO ARTICLE II,
SECTION 16, OF THE CITY CHARTER, PERTAINING
TO INTERGOVERNMENTAL AGREEMENTS, TO
A VOTE OF THE REGISTERED ELECTORS OF THE
CITY OF FORT COLLINS
WHEREAS, Article IV, Section 8, of the Charter of the City of Fort Collins
provides that the Charter may be amended as provided by the laws of the State of
Colorado; and
WHEREAS, Section 31-2-210, C.R.S. , provides that Charter amendments may be
initiated by the adoption of an ordinance by the Council submitting a proposed
amendment to a vote of the registered electors of the City of Fort Collins; and
WHEREAS, Article II, Section 16, of the City Charter presently provides
that the Council may, by ordinance or resolution, enter into contracts with other
governmental bodies to furnish governmental services and make charges for such
services, or enter into cooperative or joint activities with other governmental
bodies; and
WHEREAS, the Council believes that it would be in the best interests of the
City if the Charter were amended to clarify that the Council may delegate the
authority to execute certain kinds of intergovernmental agreements which do not
entail significant new policy matters, so that the execution of said agreements
may be accomplished more expeditiously and efficiently by administrative staff;
and
WHEREAS, by Ordinance No. 1993, the City Council has called a Special
Election to be held on November 2, 1993, in conjunction with the Coordinated
Election to be held on that date.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS
as follows:
Section 1. That the following Proposed Charter Amendment No. shall be
submitted to the registered electors of the City at the next special City
election to be held on November 2, 1993.

That Article II, Section 16, of the Charter of the City of Fort Collins is
hereby amended to read as follows:
Section 16. Contracts with other governmental bodies.
The Council may, by ordinance or resolution, enter into contracts
with other governmental bodies to furnish governmental services and
make charges for such services, or enter into cooperative or joint

Section 2. That the following ballot language is hereby adopted for
submitting Proposed Charter Amendment No. _ to the electors at said election:

AN AMENDMENT TO ARTICLE II, SECTION 16, OF THE CITY CHARTER SO AS TO
PERMIT THE COUNCIL TO DELEGATE TO THE CITY MANAGER OR HIS OR HER
DESIGNEE THE AUTHORITY TO EXECUTE INTERGOVERNMENTAL AGREEMENTS WHICH
DO NOT ENTAIL MATTERS OF NEW POLICY, ACCORDING TO SUCH CRITERIA AS
MAY BE ESTABLISHED BY THE COUNCIL BY ORDINANCE.
