HomeMy WebLinkAbout046 - 04/21/1981 - CREATING AND ESTABLISHING A DOWNTOWN DEVELOPMENT AUTHORITY IN THE CITY ORDINANCE NO. 46 , 1981 AN ORDINANCE CREATING AND ESTABLISHING A DOWNTOWN DEVELOPMENT AUTHORITY IN THE CITY OF FORT COLLINS, COLORADO . WHEREAS, by Ordinance No. 14, 1981 the Council of the City of Fort Collins , Colorado , has heretofore determined to establish a downtown development authority in the City of Fort Collins, Colorado ; and WHEREAS, pursuant to said Ordinance a special election was held in the City of Fort Collins , Colorado , on Tuesday, March 17, 1981, wherein the following question was submitted to the electors entitled to vote thereon: Shall a Downtown Development Authority be formed pursuant to Part 8 of Article 25 of Title 31, Colorado Revised Statutes , 1973, as amended , and the 1979 Cumulative Supplement thereto , thereby empowering the Council of the City of Fort Collins to assess , levy and collect an ad valorem tax upon the taxable property within the jurisdiction of the Authority not to exceed 5 mills for the use and benefit of the Authority, said Authority to exercise its powers within a District in the City of Fort Collins to be bounded as follows : Beginning at the center of the intersection of College Avenue and Laurel Street, thence Westerly to the intersection of the centerline of Laurel Street with the centerline of the alley in Block 116 extended, thence Northerly along the centerline of the alleys in Blocks 116 and 115 to the center of Mulberry Street, thence Westerly along said centerline to the intersection of Mulberry Street and Howes Street , thence Northerly to the intersection of Howes Street and Magnolia Street , thence Westerly along said centerline to the intersection of Magnolia Street and Meldrum Street, thence Southerly along said centerline to the intersection of Meldrum Street and Mulberry Street, thence Westerly along said centerline to the intersection of Mulberry Street and Whitcomb Street, thence Northerly along said centerline to the intersection of Whitcomb Street and Magnolia Street , thence Easterly along said centerline to the intersection of Magnolia Street , Sherwood Street , and Canyon Avenue , thence Northeasterly along the centerline of Canyon Avenue to the intersection of said centerline and the lot line between Lot 5 and Lot 6 of Block 83 extended , thence Northwesterly along said lot line 123. 1 feet , thence Northwesterly 86 feet to a point 50 feet Easterly from the Northwest corner of Block 83, thence Northerly 50 feet to the centerline of Olive Street , thence Easterly to the intersection of the BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS, COLORADO, THAT: -d- 1. There is hereby created and established pursuant to part 8 of article 25 of title 31, Colorado Revised Statutes 1973, as amended, a downtown development authority in the City of Fort Collins , Colorado , to be known as the "Fort Collins, Colorado , Downtown Development Authority. " 2. Said authority shall be a body corporate with all the purposes and powers now or hereafter authorized by part 8 of article 25 of title 31 , Colorado Revised Statutes 1973 , as amended , and all additional and supplemental powers necessary or convenient to carry out and effectuate the purposes and provisions of said part 8 . 3. Members of the board of said authority shall be appointed here- after by Resolution of the City Council . -6- 5. Any ordinance or resolution by which bonds are hereafter issued pursuant to part 8 of article 25 of title 31, Colorado Revised Statutes 1973, as amended , shall specify the maximum net effective interest rate of such bonds . 6. All actions not inconsistent with the provisions of this Ordinance heretofore taken by the officers of the City of Fort Collins , Colorado , whether elected or appointed , directed towards the creation and establishment of a downtown development authority and the appointment of the board thereof, are hereby ratified , approved and confirmed . 7. All ordinances or resolutions or parts thereof in conflict with this Ordinance are hereby repealed, except that this repealer shall not be construed to revive any ordinance , resolution or part thereof heretofore repealed . 8. If any section , paragraph , clause or provision of this Ordinance shall for any reason be held to be invalid or unenforceable , the invalidity or unenforceability of such section , paragraph , clause or provision will not effect any of the remaining sections , paragraphs , clauses or provisions of this Ordinance .
