HomeMy WebLinkAbout045 - 04/17/1984 - AMENDING THE ZONING CODE TO INCLUDE SOLAR NOTIFICATION SERVICE a • ORDINANCE N0.45 , 1984 OF THE COUNCIL OF THE C=OF FORT COLLINS, AMENDING THE ZONING CODE TO INCLUDE SOLAR NOTIFICATION SERVICE WHEREAS, communication between solar owners and their neighbors to the south is essential in securing private solar access agreements and protec- ting solar energy systems; and WHEREAS, notification of potential construction which would block solar access is critical in that communication process; and WHEREAS, it is desirable that the adjacent property owners be afforded a reasonable rate of time to voluntarily negotiate a mutually acceptable solution to insure solar access, prior to the commencement of any such con- struction. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1 . That Section 118-82 of the Code of the City of Fort Collins be amended to add the following Section H, Solar Notification Service, in lettered sequence: §118-82. Supplementary regulations. H. Solar notification service. (1) Upon issuance of a building permit for a solar energy system, the solar owner may register for a Solar Notifi- cation Service with the city Building Inspection Divi- sion. Solar owners who have been issued building permits for solar energy systems prior to the enactment of this service may also register for the service. (2) If the issuance of a building permit allows construction which would extend into the "solar protection area" described for a registered solar energy system, the Director of Building Inspection may place a hold of not more than ten (10) working days on the issuance of said permit. In the event any such hold is imposed, the Director of Building Inspection may immediately notify the builder of the reasons therefor and the affected solar owner. (3) The builder and the solar owner shall have ten ( 10) working days to voluntarily negotiate a solar access agreement. ....:..e.....»:s.:..x�xi<efm.:3.w,.«.»..�.:u;,✓.:,.e.......ww�s..d:.:.... (4) Failure of the Director of Building Inspection to perform any of the services herein provided shall not affect the validity of issuing a building permit by the Director of Building Inspection. (5) Following the ten (10) day negotiating period or upon sooner resolution by the parties, the Building Inspection Division shall issue the building permit, if all other requirements of the City Code have been met.
