HomeMy WebLinkAbout168 - 12/04/1984 - VACATING A PORTION OF THE RIGHT-OF-WAY OF THE FRONTAGE ROAD ALONG COLLEGE AVENUE IN FRONT OF REYNOLD ORDINANCE NO. 168, 1984 OF THE COUNCIL OF THE CITY OF FORT COLLINS VACATING A PORTION OF THE RIGHT-OF-WAY OF THE FRONTAGE ROAD ALONG COLLEGE AVENUE IN FRONT OF REYNOLDS OLDS/CADILLAC/SUBARU WHILE RETAINING IT AS A UTILITY EASEMENT WHEREAS, the Council of the City of Fort Collins has been petitioned to vacate a portion of the Right-of-Way of the frontage road along College Avenue in front of Reynolds Olds/Cadillac/Subaru set forth in more par- ticular below; and WHEREAS, this area of the right-of-way has historically been used by Reynolds Olds/Cadillac/Subaru for displaying new cars; and WHEREAS, during negotiations prior to the construction of the frontage road, the City agreed that Reynolds Olds/Cadillac/Subaru could retain the historical use of this land for vehicle display; and WHEREAS, without this vacation any cars parked in this area would be parked illegally; and WHEREAS, the City will retain said portion of the right-of-way as a utility easement; and WHEREAS, the rights of the residents of the City of Fort Collins will in no way be prejudiced or injured by said vacation. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that that certain portion of the right-of-way of the frontage road along College Avenue in front of Reynolds Olds/Cadillac/Subaru, set out more particularly as follows, to wit: A tract of land located in the SE 1/4 of Section 26, Township 7 North , Range 69 West of the 6th P. M. , City of Fort Collins , Larimer County, State of Colorado, more particularly described as follows: Considering the East line of the SE 1/4 of Section 26 as bearing N 00°04'19" E with all bearings contained herein relative thereto. Commencing at the SE corner of Section 26 , Township 7 North, Range 69 West, monumented with a steel pin and cap set by others, thence N 00°04'19" E 1344.83 feet; thence S 89°51 '19" W 90.30 feet to the true point of beginning; thence continuing S 891 51 '19" W 17. 30 feet more or less to the NE corner of a tract of land described in Book 1578 , Page 186 ; thence S 00°19'41 " • • E along East boundary of said tract 250.00 feet to SE corner of said tract; thence N 89°51' 19" E 10.74 feet; thence N 09°42' 50" E 22.91 feet to a point of curvature for a curve to the left whose radius is 167.50 feet central angle of 10°02'31" and a long chord which bears N 04°41' 35" E 29.32 feet ; thence along said curve a distance of 29.36 feet; thence leaving said curve N 00°19'41" W 198.22 feet to the point of beginning. Said tract of land contains 0.0964 acres more or less . be, with the exception of the City of fort Collins retaining the above- described property as a utility easement , vacated, abated and abolished. Introduced, considered favorably on first reading, and ordered pub- lished this 20th day of November, A.D. 1984, and to be presented for final passage on the 4th day of December, A.D. 1984.
