OF THE COUNCIL OF THE CTTY—OF FORT COLLINS
RESCINDING THE HISTORIC LANDMARK DESIGNATION
OF PROPERTY WITHIN THE CITY OF FORT COLLINS
PURSUANT TO CHAPTER 69 OF THE CODE
OF THE CITY OF FORT COLLINS
WHEREAS, on June 21 , 1977 , Ordinance No. 60, 1977 , designating the
structure located at 128-132 LaPorte Avenue, historically known as the
Myron H . Akin building , as a historic landmark , was passed on final
reading; and
WHEREAS, shortly thereafter, a demolition permit was mistakenly issued
to the owner of the property and, a few weeks later, the front portion of
the building was demolished; and
WHEREAS, due to the demolition of the front portion of the building ,
the structure no longer qualifies as a historic landmark according to the
criteria set out in Chapter 69 of the Code of the City of Fort Collins;
and
WHEREAS, Section 69-8 of the Code of the City of Fort Collins states
that a landmark designation may be rescinded in the same manner as the
original designation was made; and
WHEREAS, on October 3, 1984, after appropriate notice was given to the
owner and the public, the Cultural Resources Board held a public hearing on
the question of whether the historic landmark designation of the property
should be rescinded; and
WHEREAS, no objection to the rescission was raised at the public
hearing and the Cultural Resources Board passed a motion to recommend to
City Council that the landmark designation of the property be rescinded.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the landmark designation of the structure known as the Myron
H. Akin building, located on lands described as follows, to wit:
East 12.50 feet of Lot 43, and all of Lots 44 and 45,
in Block 22 of the City of Fort Collins , County of
Larimer , State of Colorado; also known as 128-132
LaPorte Avenue.
be, and the same hereby is, rescinded in accordance with the ordinances of
the City of Fort Collins .
Introduced, considered favorably on first reading, and ordered pub-
lished this 20th day of November, A.D. 1984, and to be presented for final
passage on the 4th day of December, A.D. 1984.
