HomeMy WebLinkAbout209 - 01/15/1985 - SUBMITTING A PROPOSED CHARTER AMENDMENT TO A VOTE OF THE REGISTERED ELECTORS OF THE CITY CONCERNING ORDINANCE NO. 209, 1984 OF THE COUNCIL OF THE CITY OF FORT COLLINS SUBMITTING A PROPOSED CHARTER AMENDMENT TO A VOTE OF THE REGISTERED ELECTORS OF THE CITY OF FORT COLLINS CONCERNING RESIDENCY REQUIREMENTS FOR CITY CLERK, DIRECTORS OF DEPARTMENTS AND CHIEFS OF DIVISIONS WHEREAS, Article IV, Section 8 of the Charter of the City of Fort Collins provides that the Charter may be amended as provided by the laws of the State of Colorado; and WHEREAS, §31-2-210, C.R.S. , provides that Charter amendments may be initiated by the adoption of an ordinance by the Council submitting a proposed amendment to a vote of the qualified electors of the City of Fort Collins. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS: Section 1. That the Council has reviewed the Charter of the City of Fort Collins and desires to submit the following proposed Charter amendment to the registered voters of the City at the next regular City election to be held on March 5, 1985: PROPOSED CHARTER AMENDMENT NO. 6 A. Section 12 of Article II of the Charter of the City is amended to read as follows: Article II City Council . Section 12. City Clerk. The City Manager shall appoint a City Clerk with the approval of the Council who shall act as Clerk of the Council and who while so employed shall be a resident of the Fort Collins Urban growth area . The City Clerk shall give notice of Council meetings, keep a journal of Council proceedings , authenticate by his or her signa- ture and record in full in a book kept for that purpose all ordinances and resolutions, and perform other duties required by this Charter or by the City Manager. B. Section 3 of Article IV of the Charter of the City is amended as follows: Article IV General Provisions "Section 3 Directors of Departments and Chiefs of Divisions. Each department shall be headed by a director appointed by and subject to the City Manager and who, while so employed , shall be a resident of the Fort Collins Urban Growth Area. Two or more departments may be headed by the same individual ; and the directors of departments may also serve as chiefs of divisions . Each department may provide for a subdivision of a department in charge of a person who is identified as a chief of a division , and is directly responsible to the director of the department and secondarily responsible to the City Manager. Any chief of a division appointed subsequent to March 5, 1985, shall , while so employed, be a resi - dent of the Fort Collins Urban Growth Area. C. Article XXI of the Charter of the City is amended by the following addition : "Fort Collins Urban Growth Area" means that geogra- phical area within and adjacent to the City of Fort Collins identified by Intergovernmental Agreement between the City of Fort Collins and Larimer County as that area identified for annexation and urbanization by the City of Fort Collins including the Urban Growth Area as it exists on March 5, 1985, together with any amendments or changes thereto. Section 2. Proposed Charter Amendment No. 6 shall be submitted to the voters in the following ballot language: PROPOSED AMENDMENT NO. 6 Amendments to the Charter of the City of Fort Collins which would require the City Clerk , Directors of Departments and Chiefs of Divisions to live within the Fort Collins Urban Growth Area.
