HomeMy WebLinkAbout135 - 10/21/2003 - APPROPRIATING UNANTICIPATED GRANT REVENUE IN THE EQUIPMENT FUND AND THE GENERAL FUND FOR THE CONGEST ORDINANCE NO. 135, 2003 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING UNANTICIPATED GRANT REVENUE IN THE EQUIPMENT FUND AND THE GENERAL FUND FOR CONGESTION MITIGATION AND AIR QUALITY PROJECTS AND AUTHORIZING THE TRANSFER OF APPROPRIATIONS WHEREAS, the City has entered into a contract with the Colorado Department of Transportation (CDOT) for 2003 and will receive a total of $262,400 in federal Congestion Mitigation & Air Quality ("CMAQ") funds to be used to construct a compressed natural gas ("CNG")fueling facility,a natural gas appliance,and provide funding for an emissions repair project to prepare the automotive industry and educate the public about on board diagnostics; and WHEREAS, the City's required local match is $55,076, and is available in the form of existing appropriations in the City's Equipment Fund ($52,176) and General Fund ($2,900); and WHEREAS, construction of the CNG fueling facility, at the City's Transfort site on Trilby Road,will provide fast fueling capability to five mini and three full-size buses,while the natural gas appliance can be used to fuel smaller vehicles in the City's fleet and serve as stand-bylback-up to the fast-fueling facility; and WHEREAS,funding for the emissions repair project administered by the Clean Air program within the Natural Resources department will be used to prepare the local automotive industry for diagnosing and repairing on board diagnostics equipped vehicles and communicating with the motoring public about on board diagnostics technology; and WHEREAS, Article V, Section 9, of the Charter of the City of Fort Collins (the "Charter") permits the City Council to make supplemental appropriations by ordinance at any time during the fiscal year,provided that the total amount of such supplemental appropriations,in combination with all previous appropriations for that fiscal year, does not exceed the then current estimate of actual and anticipated revenues to be received during the fiscal year; and WHEREAS, Article V, Section 10,of the Charter authorizes the City Council to transfer by ordinance any unexpended and unencumbered amount or portion thereof from one fund or capital project to another fund or capital project, provided that the purpose for which the transferred funds are to be expended remains unchanged; and WHEREAS, City staff has determined that the appropriation of CMAQ funds ($262,400) from the Colorado Department of Transportation,as described herein,will not cause the total amount appropriated in the Equipment Fund and General Fund to exceed the current estimate of actual and anticipated revenues to be received during the fiscal year. NOW, THEREFORE,BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That there is hereby appropriated for expenditure from unanticipated revenue in the Equipment Fund-CNG Fueling Facility and Natural Gas Appliance project,the sum of TWO HUNDRED FIFTY-ONE THOUSAND DOLLARS ($251,000) from Colorado Department of Transportation Congestion Mitigation & Air Quality funds, to be used for construction of a CNG fueling facility and natural gas appliance. Section 2. That the unexpended appropriated amount of FIFTY-TWO THOUSAND ONE HUNDRED SEVENTY-SIX DOLLARS ($52,176)is hereby authorized for transfer from the Equipment Fund operating budget to the Equipment Fund-CNG Fueling Facility and Natural Gas Appliance project, and appropriated therein, to be used for construction of a CNG fueling facility and natural gas appliance. Section 3. That there is hereby appropriated for expenditure from unanticipated revenue in the General Fund - Emissions Repair project, the sum of ELEVEN THOUSAND FOUR HUNDRED DOLLARS ($11,400) from Colorado Department of Transportation Congestion Mitigation & Air Quality funds, to be used for an emissions repair project. Section 4. That the unexpended appropriated amount of TWO THOUSAND NINE HUNDRED DOLLARS ($2,900) is hereby authorized for transfer from the Natural Resources department in General Fund to the General Fund - Emissions Repair project, for appropriation therein.
