HomeMy WebLinkAbout138 - 10/21/2003 - REZONING THE FORT COLLINS VEHICLE STORAGE AND OPERATIONS SERVICE MAINTENANCE FACILITY REZONING ORDINANCE NO. 138, 2003 OF THE COUNCIL OF THE CITY OF FORT COLLINS AMENDING THE ZONING MAP OF THE CITY OF FORT COLLINS BY CHANGING THE ZONING CLASSIFICATION FOR THAT CERTAIN PROPERTY KNOWN AS THE CITY OF FORT COLLINS VEHICLE STORAGE AND OPERATIONS SERVICE MAINTENANCE FACILITY REZONING WHEREAS, Division 1.3 of the Fort Collins Land Use Code (the "Land Use Code") establishes the Zoning Map and Zone Districts of the City; and WHEREAS, Division 2.9 of the Land Use Code establishes procedures and criteria for reviewing the rezoning of land; and WHEREAS, in accordance with the foregoing, the Council has considered the rezoning of the property which is the subject of this ordinance,and has determined that the said property should be rezoned as hereafter provided; and WHEREAS,the Council has further determined that the proposed rezoning is consistent with the City's Comprehensive Plan and/or is warranted by changed conditions within the neighborhood surrounding and including the subject property; and WHEREAS, to the extent applicable, the Council has also analyzed the proposed rezoning against the considerations as established in Section 2.9.4(11)(3) of the Land Use Code. NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the Zoning Map adopted by Division 1.3 of the Land Use Code is hereby amended by changing the zoning classification from"POL",Public Open Lands,to"E",Employment Zone District, for the following described property in the City known the City of Fort Collins Vehicle Storage and Operations Service Maintenance Facility Rezoning: A TRACT OF LAND BEING A PORTION OF THE SOUTHWEST ONE- QUARTER OF SECTION 2,TOWNSHIP 7 NORTH,RANGE 69 WEST OF THE SIXTH PRINCIPAL MERIDIAN, CITY OF FORT COLLINS, COUNTY OF LARIMER, STATE OF COLORADO, BEING DESCRIBED AS FOLLOWS: BASIS OF BEARINGS: CONSIDERING THE SOUTH LINE OF THE SOUTHWEST ONE-QUARTER OF SECTION 2 AS BEARING S89°1445"E AND WITH ALL BEARINGS CONTAINED HEREIN RELATIVE THERETO: COMMENCING AT THE SOUTHWEST CORNER OF SAID SECTION 2,THENCE S89°14'45"E ON THE SOUTH LINE OF THE SOUTHWEST ONE- QUARTER OF SAID SECTION 2, A DISTANCE OF 814.63 FEET; THENCE N00°45'15"E A DISTANCE OF 318.47 FEET TO THE POINT OF BEGINNING; THENCE N64°33'45"W A DISTANCE OF 170.59 FEET; THENCE N00°45'15"E A DISTANCE OF 600.29 FEET; THENCE S89°14'45"E A DISTANCE OF 130.00 FEET; THENCE N00"45'15"E A DISTANCE OF 276.00 FEET; THENCE S89`14'45"E A DISTANCE OF 530.00 FEET; THENCE S00`45'15"W A DISTANCE OF 1266.00 FEET TO SAID SOUTH LINE; THENCE N57°00'32"W A DISTANCE OF 597.03 FEET TO THE PONT OF BEGINNING. CONTAINING A CALCULATED AREA OF 15.252 ACRES (664,385 SQUARE FEET). Section 2. That the Sign District Map adopted pursuant to Section 3.8.7(E)of the Land Use Code be, and the same hereby is, changed and amended by showing that the above-described property is included in the Residential Neighborhood Sign District. Section 3. The City Manager is hereby authorized and directed to amend said Zoning Map in accordance with this Ordinance. Introduced, considered favorably on first reading, and ordered published this 7th day of October, A.D. 2003, and to be presented for final passage on the 21st day of October, A.D. 2003.
