HomeMy WebLinkAbout009 - 03/07/1989 - PROVIDING FOR THE IMPOSITION OF A TWENTY-FIVE HUNDREDTHS PERCENT (0.25%) SALES AND USE TAX ON ALL TA ORDINANCE NO. 9, 1989 OF THE COUNCIL OF THE CITY OF FORT COLLINS PROVIDING FOR THE IMPOSITION OF A TWENTY-FIVE HUNDREDTHS PERCENT (0.25%) SALES AND USE TAX ON ALL TAXABLE ITEMS EXCEPT FOOD FOR THE PURPOSE OF OBTAINING FUNDS FOR THE CONSTRUCTION OF CERTAIN CAPITAL PROJECTS, TO BE EFFECTIVE JANUARY 1, 1990 WHEREAS, heretofore, the City of Fort Collins has enacted a comprehensive retail sales and use tax, which enactment is codified in Chapter 25, Article III of the Code of the City of Fort Collins (the "Code") ; and WHEREAS, the amount of such tax presently imposed by the Code, as contained in Section 25-75(a) thereof, includes a twenty-five hundredths percent (0.25%) tax for the City's pool and ice rink facility, which tax shall expire at midnight on December 31, 1989; and WHEREAS, a committee composed of citizens known as the CHOICES 95 Executive Committee (the "Committee") has heretofore considered future needs for capital improvements in the community and has reported its conclusions and recommendations in the CHOICES 95 Executive Committee Final Report, dated October 7, 1988 (the "Report") ; and WHEREAS, the Council of the City of Fort Collins (the "Council ") has heretofore considered the capital improvement projects recommended by the Committee (the "Projects") and has further considered various means for generating sufficient revenue to fund the construction of such projects; and WHEREAS, the Council has identified certain of the Projects, the construction of which it deems necessary and desirable in the interests of the citizens of Fort Collins, at an approximate total cost of Twenty-three Million Two Hundred Thirty-six Thousand Seventy-nine Dollars (E23,236,079) ; and WHEREAS, the Council has further determined that it would be necessary and desirable, upon the expiration of the existing tax for the City's pool and ice rink, to fund a substantial portion of said costs by the imposition of a new twenty-five hundredths percent (0.25%) sales and use tax on all taxable items except food, commencing January 1, 1990. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1 . That Section 25-75(a) of the Code of the City of Fort Collins is hereby amended to read as follows: (a) The amount of tax hereby levied is two and seventy-five one-hundredths (2.75) percent of the purchase price of tangible personal property or taxable services. Twenty-five one-hundredths (0.25) percent of such amount is a tax which shall expire at midnight on December 31, 1997, and the proceeds of which shall be placed in the capital projects fund of the city for the construction of certain capital projects as determined by the Choices 95 Executive Committee and approved by the Council . An additional twenty-five one-hundredths (0.25) percent is a tax, which shall expire at midnight on June 30, 1989, and the proceeds of which shall be placed in the capital projects fund for the necessary capital projects as determined by the RECAP Committee. Section 2. That the revenue raised which is attributable to the portion of the twenty-five hundredths percent (0.25q) sales and use tax revenues collected pursuant to this ordinance shall be used for the following categories of projects as referred to in the Report: 1 . PARKS & OPEN SPACE CAPITAL PROJECTS: Older Adult Center Eastside Neighborhood Park SW Community Park Land Acquisition Buckingham Park Enhancements Edora Park Enhancements Indoor Pool Renovations 2. OTHER PUBLIC FACILITIES CAPITAL PROJECTS: PFA Station #10 Land Acquisition PFA South Battalion Lincoln Center Restrooms 3. STREETS/TRANSPORTATION CAPITAL PROJECTS - Those which improve traffic safety and provide for increased capacity of major streets and intersections. Such projects include: Shields, Laurel to Prospect Prospect-Shields Intersection Prospect-College Intersection Drake-Canterbury to Taft Hill Prospect-Lemay Intersection Eastside Neighborhood Intersection College-Drake (Double Left/Right Turns) Drake-Taft Hill Intersection Prospect-Taft Hill Intersection Shields, Davidson to Casa Grande Prospect, Shields to Taft Hill Timberline Extension - Prospect to Summitview Section 3. That the Council shall authorize, by ordinance, the appropriation and expenditure of sales and use tax revenues J. collected pursuant to this Ordinance. Any revenues not so authorized for expenditure on or before January 1, 1997 may be used for any other capital project which may be approved by the Council . Section 4. That the amendment of Section 25-75(a) of the Code set forth herein shall take effect at 12:01 a.m. on January 1, 1990. Section 5. That, except as provided herein, all other provisions of Chapter 25 of the Code shall remain in full force and effect until otherwise rescinded or modified by action of the Council of the City of Fort Collins.
