OF THE COUNCIL OF THE CITY OF FORT COLLINS
ANNEXING PROPERTY KNOWN AS THE
BURLINGTON NORTHERN SOUTHEAST SECOND ANNEXATION
TO THE CITY OF FORT COLLINS, COLORADO
WHEREAS, Resolution 91-76, stating the intent of the City of Fort Collins
to annex certain property and initiating annexation proceedings, has heretofore
been adopted; and
WHEREAS, the Council of the City of Fort Collins does hereby find and
determine that it is in the best interests of the City to annex said area to the
City.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS
as follows:
Section 1. That the following described property, to wit:
A tract of land situate in Sections 12 and 13, Township 7 North,
Range 69 West and Section 18, Township 7 North Range 68 West of the
6th P.M. , Larimer County, Colorado, which considering the South line
of the Southeast Quarter of said Section 18 as bearing S 88°47'08"
W, and with all bearings contained herein relative thereto is
contained within the boundary lines which begin at the Southeast
corner of said Section 18 and runs thence S 88°47'08" W 436.06 feet
along the South line of Section 18 to the true point of beginning,
being a point on the Easterly ROW line of the Burlington Northern
Railroad; thence S 88°47'08" W 106.42 feet; thence along the arc of
a 2914.93 foot radius curve to the left a distance of 37.98 feet,
the long chord of which bears N 20°29'27" W 37.98 feet; thence along
a spiral out with a length of 151.31 feet and a delta of 1°30'00"
the long chord of which bears N 19°07' 11" W 151 .30 feet; thence N
18037'03" W 1320.10 feet; thence along a spiral in with a length of
147.00 feet and a delta of 3000'00", the long chord of which bears
N 19°36'31" W 147.36 feet; thence along the arc of a 1382.69 foot
radius curve to the left a distance of 1101.25 feet, the long chord
of which bears N 44°26'03" W 1072.37 feet; thence along a spiral out
with a length of 147.00 feet and a delta of 3°00'00", the long chord
of which bears N 69015'36" W 147.36 feet; thence N 70°15'03" W
1004.90 feet; thence along a 8644.42 foot radius curve to the right
a distance of 2496.77 feet, the long chord of which bears N
61°58'36" W 2488.10 feet; thence S 88°35'55" W 16.51 feet; thence
N 49632'04" W 2918.80 feet; thence N 48°52'03" W 701.26 feet to a
point on the West line of the Southeast Quarter of said Section 12;
thence along the West line of the Southeast Quarter of Section 12

S 40014'35" W 30.00 feet; thence S 49045'25" E 1138.21 feet; thence
S 50009'03" E 1666.50 feet; thence S 52022'00" E 576.30 feet; thence
N 88°35'55" E 61.00 feet; thence along a 8544.42 foot radius curve
to the left a distance of 2337.20 feet, the long chord of which
bears S 62°24'53" E 2329.92 feet; thence S 70°15'03" E 1004.90 feet;
thence along a spiral in with a length of 152.62 feet and a delta
of 3°00'00" the long chord of which bears S 69014'33" E 152.60 feet;
thence along a 1482.69 foot radius curve to the right a distance of
1180.89 feet, the long chord of which bears S 44°26'03" E 1149.93
feet; thence along a spiral out with a length of 152.62 feet and a
delta of 3°00'00", the long chord of which bears S 19'37'34" E
152.60 feet; thence S 18°37'03" E 1320.10 feet; thence along a
spiral in with a length of 148.69 feet and a delta of 1030'00", the
long chord of which bears S 19°06'56" E 148.69 feet; thence along
a 2814.93 foot radius curve to the left a distance of 72.46 feet,
the long chord of which bears S 20°51' 18" E 72.46 feet to the point
of beginning.
Containing 18.3471 acres;
be, and hereby is, annexed to the City of Fort Collins and made a part of said
City, to be known as the Burlington Northern Southeast First Annexation.
Section 2. That, in annexing said property to the City, the City does not
assume any obligation respecting the construction of water mains, sewer lines,
gas mains, electric service lines, streets or any other services or utilities
in connection with the property hereby annexed except as may be provided by the
ordinances of the City.
Section 3. That the City hereby consents, pursuant to Section
37-45-136(3.6) , C.R.S. , to the inclusion of said property into the Municipal
Subdistrict, Northern Colorado Water Conservancy District.
Introduced, considered favorably on first reading, and ordered published
this 2nd day of July, A.D. 1991, and to be presented for final passage on the
16th day of July, A.D. 1991 .
