OF THE COUNCIL OF THE CITY OF FORT COLLINS
BEING AN ORDINANCE VACATING A RIGHT-OF-WAY
LOCATED IN LESSER'S SUBDIVISION
AND RESERVING THE SAME FOR UTILITY PURPOSES
WHEREAS, the City Council has been petitioned to vacate a right-of-way
located in the Northeast 1/4 of Section 13, Township 7 North, Range 69 West
of the 6th Principal Meridian, City of Fort Collins, more particularly
described below; and
WHEREAS, City agencies and utility companies have been contacted and
report no objection to the proposed vacation and reservation; and
WHEREAS, there will be no cost to the City in making the proposed
vacation and reservation; and
WHEREAS, it appears that the rights of the residents of the City of
Fort Collins will not be prejudiced or injured by the vacation of said
right-of-way.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the right-of-way, more particularly described as follows,
to-wit:
A part of East Myrtle Street which begins at the Northwest
corner of Lot 13, Lesser's Subdivision, City of Fort Collins,
County of Larimer, State of Colorado, and runs thence East
125.00 feet to the Northeast corner of said Lot 13; thence
North 4.00 feet; thence N 49° 25' W 47.28 feet; thence along
the arc of a 15.00 foot radius curve to the left a distance
of 21 .13 feet, the long chord of which bears N 89° 46' 30" W
19.43 feet; thence along the arc of a 166.00 foot radius
curve to the right a distance of 78.62 feet, the long chord
of which bears S 63' 26' 06" W 77.89 feet to the point of
beginning, containing 2,392 square feet more or less.
be, and the same hereby is, abolished, vacated and abated, reserving,
however, unto the City the above described right-of-way for utility
purposes only.
Introduced, considered favorably on first reading, and ordered
published this 19th day of July, A.D. 1988, and to be presented for final
passage on the 2nd day of August, A.D. 1988.
